OBSERVED VIOLATIONS:

1. 15A North Carolina Administrative Code 13B .0510(c) states: When a solid waste disposal site has been closed
in accordance with the requirements of the Division, future necessary maintenance and water quality monitoring
shall be the responsibility of the owner and operator.

 .0503(2)(a) states: “A site shall meet the following design requirements:
a. The concentration of explosive gases generated by the site shall not exceed
i. twenty-five percent of the limit for the gases in site structures (excluding gas control or
recovery system components); and
ii. the lower explosive limit for the gases at the property boundary”;

During the inspection, it was determined that permanent methane monitoring devices were never installed. There are no
records showing that Davie County has performed explosive gas monitoring at the closed C & D Landfill as required in
Rule 15A NCAC 13B .0503(2)(a).

Therefore, within 90 days of receipt of this comprehensive inspection report, Davie County must develop and
submit a landfill gas monitoring plan to the Section for approval. The landfill gas monitoring plan should satisfy
all conditions of Rule 15A NCAC 13B .0503(2)(a)(i) and (ii). Please submit copies of the monitoring plan to:

2. 15A NCAC 13B .0510(c) states: “When a solid waste disposal site has been closed in accordance with the
requirements of the Division, future necessary maintenance and water quality monitoring shall be the responsibility of
the owner and the operator”.

During the inspection, trees were observed on the western side slopes of the landfill. Edge of waste markers were
installed showing that trees are growing on the cap over waste. Thus, the final cover system was not maintained. This
constitutes a violation of 15A NCAC 13B .0510(c).

To achieve compliance, within ninety (90) days from the receipt of this inspection report, Davie County must
develop and submit to the Section a written maintenance plan which ensures landfill cap integrity. At a minimum
this plan should include a schedule for routine inspections of the following:

a. Vegetation on the cap is mowed sufficiently to allow for inspection of the cap;
b. Management of trees and woody vegetation (including dead, dying, or diseased trees) and
maintenance of the cap of the landfill, such that the landfill can readily be inspected;
c. Any surface erosion is repaired and re-seeded as necessary;
d. Erosion is controlled and repaired to ensure that no silt or sediment leaves the site;
e. Any leachate seeps in the cap are repaired;
f. Any areas of bare soil are reseeded to establish a vegetative cover;
g. Any areas of subsidence of the cap are repaired, re-sloped and reseeded as necessary to ensure
the controlled shedding of surface water from the cap; and
h. The edge-of-waste markers are maintained in good repair.

ADDITIONAL COMMENTS

1. The facility operated as a municipal construction and demolition landfill and ceased receiving waste in 2003.
2. Closure activities were completed in 2005.
3. Groundwater monitoring is being performed semi-annually. An inspection of the monitoring network will be
conducted in the future. Please ensure all monitoring wells are locked, labeled and accessible.
4. It was the Solid Waste Section’s understanding that as part of groundwater remediation, a plan entitled “Work Plan –
Additional Landfill Assessment” “was submitted to the Section on September 15, 2009 on behalf of Davie County
and approved by Jaclynne Drummond, Compliance Hydrogeologist, on October 15, 2009. The plan stated that:
“S&ME will prepare a Gas Remediation Plan which will call for a phase approach to reduce the phase transfer of
VOCs to the groundwater. The Gas Remediation Plan will be prepared in accordance with 15A NCAC 13B
.0503(2)(a)”. There is no evidence that a Gas Remediation Plan was prepared and submitted to the Section. Please
contact Elizabeth Werner, Permitting Hydrogeologist, to complete this requirement and move groundwater
remediation at this site forward.
5. The landfill cap was stabilized with native vegetation. The landfill is leased for purposes of bird hunting. In this
capacity, the vegetation on the top of the landfill is kept tall with hunting lanes mowed throughout the site. The tall
vegetation can prevent a thorough inspection for evidence of leachate outbreaks and settling of the landfill cap. It is
recommended that the entire landfill be mowed periodically and notification be made to Solid Waste Section staff to
facilitate a thorough inspection of the landfill cap.
6. Edge of waste markers were in place at the time of inspection. Please ensure that markers are clear and
unobstructed by vegetation.
7. An area of erosion approximately 8’ x 25’ was observed off the footprint of the landfill near the north side of the
landfill. This area should be stabilized with a permanent groundcover sufficient to restrain erosion.
8. Post-inspection research was conducted to better understand the facility and its closure processes. Research
included a review of the facility file, previous inspection reports, permitting records, correspondence and memos.
This research was concluded on March 22, 2017.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
