Comprehensive Inspection of Closed MSW Landfill

STATUS OF PAST NOTED VIOLATIONS:
15A NCAC 13B .0503(2)(a)(ii) The concentration of explosive gases generated by the site shall not exceed the lower
explosive limit for the gases at the property boundary.

A Notice of Violation was issued November 2, 2001 for exceedances of landfill gas at the property of the boundary of
the landfill. Macon County installed a 75-foot landfill gas trench and three vent stacks in December 2001 and January
2002. The section authorized Macon County to monitor the trench to ensure that the trench would function as designed.
The section required that if after an observation period it was determined that methane concentrations at any depth along
the property boundary exceeded the regulatory limit, additional corrective measures would be necessary.

Due to consistently elevated landfill gas levels in excess of the Lower Explosive Limit for methane in boundary wells
13i and 13d, Macon County must submit a summary of all past landfill gas detections and a plan for improvements to
the current landfill gas trench to Ervin Lane, Compliance Hydrogeologist. Additional corrective measures may be
required, should the plan fail to reduce methane levels at the facility boundary. Please submit the plan to:

OBSERVED VIOLATIONS:
Please see Status of Past Noted Violations section of this report as corrective measures, including a
monitoring/observation period, have been in progress to address ongoing landfill gas exceedances.

ADDITIONAL COMMENTS
1. All photographs were taken by Lee Hill on January 17, 2017.
2. Ground and surface water monitoring is being conducted on a semi-annual basis. The October 14, 2015 and
April 12, 2016 ground and surface water reports were reviewed.
3. Landfill gas reports were reviewed 03/29/16, 06/28/2016, 10/04/2016, and 12/28/2016. All reports had
exceedances of the 5% LEL in boundary wells.
The following is a brief history of landfill gas issues at the Old Franklin Landfill:

 A Notice of Violation was issued for landfill gas exceedances at the property boundary was issued by
Mark Poindexter in November 2, 2001.
 November 28, 2001 the former Solid Waste Director, Larry Lackey spoke with a Klatt family member
who owns the land south of the landfill about purchasing additional buffer area. The Klatt family was
not interested in selling any property.
 An additional 100-foot buffer was purchased from the Emmanuel Baptist Church in December 2001.
 A 75-foot landfill gas trench with vent stacks was installed in December 2001 and January 2002
 A letter from James Coffey dated April 24, 2002 was sent to Michael C. Stahl, Macon County Solid
Waste Director stating in part that “If at any time there are significant changes around the area of
concern, such as construction of development, it may be necessary to take immediate action to protect
public health.”
 On June 2, 2006 a letter about “Landfill Gas Issues Along Southern Boundary Old Franklin Landfill,
Permit #57-01” was submitted to Ethan Brown by Michael Chris Stahl.
 During the January 30, 2017 conference Chris Stahl stated that Macon County would provide statistical
data for the landfill gas to the section.

4. Vegetative cover was well established on the cap and is being mowed and maintained on a regular basis.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

5. No erosion issues or ponding water was observed on the cap.
6. Ground water monitoring wells were observed and were secured with the exception of MW-2 which was
missing the top. Please replace the top of MW-2 to protect the integrity of the well.
7. On March 3, 2000 approval was given by Jim Coffey to use part of the cap as a Radio Controlled Aircraft
airstrip. All structures located at the airstrip are weighted down by concrete and the cap has not been
penetrated.
8. A law enforcement shooting range located in an old soil borrow area was approved by the Solid Waste Section
on February 27, 2012 by Allen Gaither, Permitting Engineer.
