STATUS OF PAST NOTED VIOLATIONS:
15A NCAC 13B .0503(2)(a)(ii) – Corrective actions for landfill gas exceedances at the facility boundary are ongoing.
OBSERVED VIOLATIONS:
None
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The property lines and limits of waste have not been completely delineated with permanent markers. Permanent
waste boundary and property line markers must be installed at landfill. (See the attached May 29, 2009 Memo:
Permanent Edge-of-Waste Markers at Construction and Demolition Debris Landfills, Industrial Solid Waste Landfills
and Municipal Solid Waste Landfills)
Within 90-days of your receipt of this report, please determine and mark the limits of waste of the
landfill; and determine and mark the property lines of the landfill in accordance with the attached
May 29, 2009 Memo.
1. Looking (S) from Brushy Creek Rd. at the entrance to
the landfill. (Access road to Unimin / Harris Mining is on
the right.
2. Looking (E) down the perimeter “road” of the landfill
at trees / woody vegetation on the landfill slopes. The
landfill is on the left. (Note the edge-of-waste marker.)

2. There are multiple trees and woody vegetation on the southern and western slopes of the landfill that must
be removed in order to protect the integrity of the cap. (Photo #2 - #4).
Within 90-days of your receipt of this report remove all trees and woody vegetation that are on the landfill
and within the limits of waste.
3. A random inspection of landfill gas monitoring and ground water monitoring wells (Photos #5 - #6) found all
wells to be properly secured, identified and maintained.
4. The most recent semi-annual water quality monitoring event was conducted by Smith+Gardner, Inc. on
September 3RD and 4TH 2015. Three groundwater monitoring wells (MW-1 through MW-3) along with two
surface water monitoring locations (SW-1 and SW-2) at that time.
No inorganic constituents were detected above the 2L Standard for this event.
No organic constituents were detected above the 2L Standard in this event.
No constituents were detected above the 2B Standard for Class C Waters.
5. The most recent landfill gas monitoring (LFG) event was conducted by Smith+Gardner, Inc. on October 1, 2015.
In addition to thirteen landfill gas monitoring wells (P-1 through P-13), ten landfill gas monitoring recovery points
(Avery-W1 through W-10) along with the landfill gas flare were evaluated. Only on monitoring well, LFG P-3
exceeded the LEL for methane.
6. The cap of the landfill had recently been mowed and was in good condition. There was no evidence of any
differential settling of the cap.
7. There was no evidence of any ponding of water on the cap.

8. There was no evidence of any on site erosion.
9. Access to the site from Brushy Creek Rd. is secured by a locked gate. (Photo #1)
10. The cap of the landfill has a well-established vegetative cover. (Photos #7 and #8)
