Rowan County is in violation of 15A NCAC 13B .1626 (2)(c) for failure to ensure a minimum of one foot of intermediate cover is maintained. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 During the inspection several areas located on the North and Northwest side of the closed MSW cell #1 was observed to have inadequate ground cover and erosion issues. Rills have developed which had exposed waste. To achieve compliance, Rowan County must apply a minimum of one foot of intermediate cover by February 18, 2017. CORRECTIVE ACTION IN PROGRESS: Rowan County provided photographs on January 19, 2017 documenting corrective actions taken to resolve the violation. 2. 15A NCAC 13B .0402 (1) states: “Operational plans shall be approved and followed as specified for the facility”. The approved Facility Operations Plan Rowan County Landfill Phase IV, dated June 2012 (DIN 17147, Page 9) states: “Erosion/Sedimentation Control Maintenance and Water Protection”, “Embankment slopes shall be periodically inspected for erosion. The embankment slopes shall be mowed at least once a year. The embankment slopes shall be refertilized after seeding unless vegetation growth is fully adequate. Seeding, fertilizing and mulching shall be in accordance with the North Carolina Erosion and Sedimentation Control Guidelines. Provisions for a vegetative ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of landfill development”. Rowan County is in violation of 15A NCAC 13B .0402(1) in that they did not maintain damaged areas of embankment slopes by reseeding, fertilizing and mulching immediately until vegetation growth is established. During the inspection several areas located on the North and Northwest side of the closed MSW cell #1 was observed to have inadequate ground cover and erosion issues. Rills have developed which had exposed waste. To achieve compliance, Rowan County must ensure that sufficient vegetative cover is established on slopes to prevent erosion. Vegetation must be well established to determine if compliance has been achieved. CORRECTIVE ACTION IN PROGRESS: Rowan County provided photographs on January 19, 2017 documenting corrective actions taken to resolve the violation. 3. 15A NCAC 13B .1626 (8)(b) states: “Surface water shall not be impounded over or in waste”. Rowan County is in violation of 15A NCAC 13B .1626 (8)(b) for failure to ensure surface water is not impounded over waste. During the inspection several areas located on the North and Northwest side of the closed MSW cell #1 was observed to have surface water impounded. To achieve compliance, Rowan County must ensure all surface water is diverted to storm water structures to prevent impounding by March 18, 2017. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 6 CORRECTIVE ACTION IN PROGRESS: Rowan County provided photographs on January 19, 2017 documenting corrective actions taken to resolve the violation. ADDITIONAL COMMENTS 1. Proper signage was observed at the entrance of the facility. 2. The facility is permitted to receive solid waste generated with Rowan County and out of county waste within the State of North Carolina. The facility receives waste from Cabarrus County, Davidson County, Davie County, Iredell County, Stanley County and Rowan County. 3. The Rowan County facility accepted an average of 421.93 tons per day for calendar year 2016. For calendar year 2015 the facility accepted an average of 420.32 tons per day. Operations Inspection of the MSW Landfill Unit: 4. The facility is currently working in Phase 4. 5. No unacceptable waste streams were observed in the MSWLF. A pallet and two tires had been pulled out to be moved to the T & P and Tire Collection areas. 6. Edge of waste markers were observed. 7. Working face was small and compact. 8. The facility utilizes synthetic tarps as daily cover and soil once a week. 9. All access roads maintained in good condition. 10. Facility staff was actively picking up windblown waste during inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Training records were reviewed. 13. 1st Semi-Annual groundwater monitoring dated March 2016 and 2nd Semi-Annual groundwater monitoring dated October 2016 were reviewed. MW-28 shows exceedances and the county is working with Jaclynne Drummond, Compliance Hydrogeologist to further monitor. Appendix 2 testing has been implemented. 14. Methane monitoring was being performed as required. Reviewed 1st quarter 2016, 2nd quarter 2016, 3rd quarter 2016 4th quarter 2016. No exceedances were documented. 15. Random inspection reports were reviewed. Facility staff perform 2 per week. Reviewed records from January 1 to December 31, 2016. 16. Leachate is discharged by a force main to the City of Salisbury WWTP. 17. Myers - Certified Landfill Operations Specialist expires March 22, 2019 Mulching and Grinding (T & P area) 18. Pallets observed in this area. Observed some pallets with plywood, OSB and part of a telephone pole which were pointed out to facility staff. Facility staff said their normal practice is to pull out the plywood, OSB and other unacceptable waste and take it to the MSW for disposal. Material is ground twice a year. Mulch is not distributed to the public. 19. Temporary disaster debris site (DS80-001) is located in this area, and is still available for use according to facility staff. White Goods & Scrap Metal Collection Area 20. Area is well maintained. 21. White goods are hand loaded into a large roll off container which is transported by the contractor to their facility for CFC removal and recycling. The current contractor is Foils. Scrap metal is accumulated in this area for recycling also. Tire Collection Area 22. Area is well maintained. 23. Scrap tire certifications are collected at the scale house and facility staff direct citizens to the tire collection area to unload tires into the trailer. Convenience Drop off Area 24. Area is well maintained. 25. Area is set up for drop off of trash, recyclables, used motor oil, electronics, used motor oil filters and batteries. Closed Construction and Demolition Landfill 26. The closed C&D Landfill had established vegetative cover. 27. Edge of waste markers were observed.
