Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on January 17, 2017. 2. The facility stopped receiving waste on June 30, 2008. The closure and post closure plan was received by the section on July, 1, 2008. The final landfill cap was certified as constructed in the closure plan by Jeff Bishop, P.E., Senior Project Manager, McGill Associates which received approval from NCDENR – Solid Waste Section on December 19, 2008. 3. The landfill cap had good vegetative cover and was mowed in the fall of 2016. No erosion issues were observed on the cap at the time of inspection. 4. The groundwater wells were observed and the hinge of MW-A was broken and the lock was missing off of MW-B. Please repair the hinge of MW-A and replace the lock on MW-B to protect the integrity of the well. 5. Ground and surface water monitoring is being conducted on a semi-annual basis. The October 12, 2015 and April 12, 2016 ground and surface water reports were reviewed. 6. Landfill gas records from August 28, 2015 were reviewed and no methane was detected. 7. On July 3, 2013 a letter from the Permitting Branch requesting an explanation and support of a landfill gas investigation that was performed in April, 2011 was sent to Macon County. An explanation letter was submitted to the Permitting Section on August 26, 2013 by Macon County. The Permitting Section received a request from McGill Associates on behalf of Macon County for cessation of post-closure care and monitoring of the Highlands C&D Landfill. On September 18, 2015 the Permitting Section sent a letter to Macon County confirming that it had received the request for the cessation of post-closure care and monitoring at the Highlands C&D Landfill facility. This request continues to be under review by the Permitting Branch.
