Mr. Brown,
The Division of Waste Management, Solid Waste Section (Section) has received your application
submittal titled Permit Modification (DIN 25852). The application was submitted on your behalf
by Civil & Environmental Consultants, Inc. (CEC) to Mr. John Murray on January 29, 2016. The
application was forwarded to my attention in the Asheville Regional Office on November 16,
2016.
The submittal has been reviewed for completeness in accordance with General Statute 130A-
295.8(e). A determination of completeness means that the application includes all required
components but does not mean the required components provide all of the information that is
required for the Section to make a decision on the application.
The application cover letter stated the facility is not proposing to modify: the facility plan, the
engineering plan, the construction quality assurance plan, the monitoring plans; and the closure
and post-closure plan. However, Section 2.0, Summary of Modifications, of the application
indicates the edge of waste limits had been adjusted to maximize the proposed waste footprint.
Further correspondence with CEC demonstrates the changes to the edge of waste limits amount to
a 3.10-acre increase in the disposal area. This change is significant and considered a lateral
expansion of the landfill and, therefore, an amendment to the permit. As a result, an amendment
application in accordance with 15A NCAC 13B.0535(b), incorporating all the proposed design
changes, must be submitted to the Section for review.
Rule .0535(b) requires an updated engineering plan, construction quality assurance plan, operation
plan, closure and post-closure plan and monitoring plan. The Permit Modification submittal only
included a revised operation plan. As all of the components required by 15A NCAC 13B.0535(b)
have not been submitted the application is deemed incomplete.

In order to complete the application and continue the review, please submit an updated
engineering plan, construction quality assurance plan, closure and post-closure plan and
monitoring plan in accordance with Rule .0535(b). Additionally, given the increase in the size of
the disposal area, I request you also submit an updated facility plan prepared in accordance with
Rule .0537.
