Current – Approved January 2, 2015 (DIN 22567) expires April 3, 2019
Operations Plan – Approved September 16, 2014 (DIN 21693)
PURPOSE OF SITE VISIT:
Follow-up inspection to Evaluate Status of Corrective Actions required by the Notice of Deficiency (NOD) issued on
June 19, 2015.
STATUS OF PAST NOTED VIOLATIONS:
1. RESOLVED: 15A North Carolina Administrative Code .1626(7)(c) Erosion and sedimentation
control requirements states, “Provisions for a vegetative ground cover sufficient to restrain erosion must
be accomplished within 30 working days or 120 calendar days upon completion of any phase of MSWLF
development.”
During the inspection on 6-9-15 and 7-24-15 Gaston County was in violation of 15A NCAC .1626(7)(c) in
that it had failed to provide a vegetative ground cover sufficient to restrain erosion on the upper SW slopes
of the MSWLF Unit 1. Vegetative cover is required to be accomplished within 30 working days or 120

calendar days upon completion of any phase of MSWLF development. Sides Seeding was contracted to seed
and sow the upper SW slope of the MSWLF Unit 1 which was completed in March 2016. At the time of the
follow-up inspection vegetative ground cover is established on this slope. Therefore, this violation is
considered resolved.

ADDITIONAL COMMENTS
1. This was a follow-up inspection for the 7-24-15 inspection to evaluate status of corrective actions required by the
Notice of Deficiency (NOD).
2. A comprehensive inspection will be scheduled at a later date.

administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
