Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS The facility is a LCID landfill that was originally permitted by Wake County under a memorandum of understanding. The current permitting authority is the DEQ -Solid Waste Section (SWS). A permit modification was issued by NCDENR (now DEQ) on December 8, 2011. This Permit to Operate expires December 8, 2016. The facility permit renewal application was submitted to the SWS on November 3, 201 and is currently under review. 1. As an LCID landfill the facility is allowed to receive land clearing waste; yard trash; untreated and unpainted wood; uncontaminated soil; inert debris such as unpainted rock, brick, concrete, and concrete block; and asphalt in accordance with NCGS 130-294(m). 2. The facility is secured with a gate during hours of non-operation. The posted operating hours are 8am-5pm, Monday through Friday. The facility has proper signage. 3. Operations were discussed with Mr. Blackwell. 4. The facility currently segregates different materials for treatment and processing. Land clearing waste consisting of stumps and logs was the primary material observed on-site. 5. The facility tracks incoming loads on individual tickets. Each load ticket lists the company of the hauler, the driver name, date, and the signature of the driver. 6. No unpermitted waste was noted during inspection. Unpermitted material such as treated wood and other miscellaneous construction debris are removed from the incoming waste for proper disposal at a permitted facility. 7. The facility pad/landfill cap appeared to be in good condition. No holes, ruts, or areas of ponding were observed. No erosion or runoff was observed. 8. Ensure that ground cover sufficient to restrain erosion is established within 30 working days or 120 calendar days upon completion of any phase of landfill development. Eastern slopes had been recently mowed. Mr. Blackwell indicated that reseeding of any bare spots and side slopes would occur when the weather becomes favorable for new groundcover. 9. Edge of waste markers need to be installed and maintained while the landfill is in operation. 10.
