Geosyntec Consultants of North Carolina, PC (Geosyntec) has prepared this memorandum on
behalf of Duke Energy Progress, LLC (DEP) to request authorization and obtain concurrence
from the North Carolina Department of Environmental Quality (NCDEQ) on the redesign of the
North Surface Water Pond (NSWP) associated with the onsite coal combustion residuals (CCR)
landfill (landfill) at the L.V. Sutton Energy Complex (Sutton).
NCDEQ issued DEP a permit to construct and operate the Sutton landfill on 21 September 2016.
The permit was issued based on the document titled “Onsite CCR Landfill Construction
Application Report” (Application) prepared by Geosyntec, dated 7 August 2015, and revised in
December 2015. The drawing set titled “Construction Permit Application Drawings – Onsite
CCR Disposal Facility,” dated August 2015 was submitted as Appendix A of the application and
provided the design of the NSWP in support of the landfill construction and operation.
However, additional construction activities (i.e., boat ramp access road relocation and security
fence) at Sutton, unrelated to the landfill, encroached on portions of the NSWP. As such,
Geosyntec has redesigned the NSWP to eliminate construction conflicts with these structures.
The NSWP redesign is considered minimal and was achieved such that the original storage
capacity of the pond was maintained. Specifically, (i) portions of the eastern NSWP berm was
relocated towards the west; and (ii) the north NSWP berm was moved further north to maintain
equivalent storage capacity. Additionally, the NSWP culvert outlet was relocated (shortened)
from originally proposed location to eliminate construction conflicts with the new boat ramp
access road. A copy of the redesigned NSWP is submitted as an attachment to this
memorandum.
