Pisgah Cemetery Road Conway, SC 29526 RE: Financial Assurance Closure Estimate Approval for 2016 Facility: 908 Recycling Recovery Site., proposed permit no. 1011-MWP-2016 C&D Material Recovery BRUNSWICK County, DIN No. 27079 Dear Mr. Lander, The Division of Waste Management – Solid Waste Section (Section) has approved Hot Mix Inc.’s financial assurance closure estimate (2016 dollars) of $8,690 which will allow 80 tons of stored C&D waste materials per a five-day week. Hot Mix, Inc. shall establish financial assurance mechanism(s) in the amount of $8,690 prior to issuance of a permit to operate. Approved closure estimate Allowable stored C&D waste within a 5-day week $8,690.00 80 tons At this time, Hot Mix, Inc. may choose to establish financial assurance as an irrevocable letter of credit and a standby trust. Once the irrevocable letter of credit is in place, a standby trust shall be established with a financial institution. The proposed permit number 1011-MWP-2016 will be needed to complete the letter of credit and standby trust templates, which can be found at http://go.ncdenr.gov/fa under the header labeled, “Mechanisms for all other Solid Waste Management Facilities:” At no time can Hot Mix, Inc. operate as a C&D Material Recovery facility prior to receipt of a Permit to Operate from the N.C. Department of Environmental Quality – Division of Waste Management, Solid Waste Section. The Section requires original hard copies of the letter of credit and standby trust, prior to approval of these documents. Feel free to contact me with draft documents prior to finalizing Hot Mix, Inc.’s mechanisms. On an annual basis, the closure amount shall be updated for inflation and a revised mechanism will be due to the Section by the establish date of the letter of credit. Schedule A from the Standby Trust Agreement shall be updated with the revised letter of credit amount and submitted to the Section. Should Hot Mix, Inc. want to modify their permit in the future by increasing their tonnage and in doing so, their financial assurance, please contact Pat Backus at 919-707-8257.
