ADDITIONAL COMMENTS
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
OBSERVED VIOLATIONS:
1.The facility is permitted to receive land clearing waste;yard trash;un-treated and unpainted wood,uncontaminated soil,inert debris such as
unpainted rock,brick,concrete,concrete block and asphalt.
2.The facility is located adjacent to the closed MSW landfill (Permit No.87-01).
3.The facility is secured by gate located near Buckner Branch Rd.
4.Roads at the facility are constructed of all weather material.
5.No unapproved material was observed at the time of inspection.
6.Recent monthly cover had been applied to the working face.
7.No sign was observed at the entrance on the landfill.Please see observed violations section of this report.
8.The permit to operate expires on December 2,2016.Contact the permitting staff no later than July 2,2016 if you wish to renew the facility permit.
9.The facility appeared to be well managed at the time of the inspection.
15A NCAC 13B.0566 (16)states:A sign shall be posted at the facility entrance showing the contact name and number in case of an emergency and
the permit number.The permit number requirement is not applicable for facilities not requiring an individual permit.
Swain County LCID Landfill is in violation of 15A NCAC 13B.0566 (16)in that on April 21,2016 there was no sign was posted at the entrance to the
landfill.
In order to come into compliance,by May 31,2016,post a sign at the entrance to the landfill showing the contact name and number in case of an
emergency and the permit number.
