Holly, NC 28120 PARTICIPANTS: Dwayne McCorkle, Jr. – Old Hwy 27 Landfill Kim Sue, NCDEQ – Environmental Senior Specialist - Solid Waste Section STATUS OF PERMIT: Permit to construct the Old 27 LCID Landfill was issued to Dwayne E. McCorkle on April 11, 2011. The permit to operate expired on October 21, 2015. However, a permit application for renewal was received by the Solid Waste Section on March 14, 2016. PURPOSE OF SITE VISIT: Operational Inspection STATUS OF PAST NOTED VIOLATIONS: 1. RESOLVED: 15A North Carolina Administrative Code 13B .0566(1) requires, in part, that “Operational plans shall be approved and followed as specified for the facility.” Item 6 of Attachment 3 of the “Permit to Construct and Operate” dated April 11, 2011 (DIN 13403) states “the permanent markers that accurately delineate the waste boundary must be maintained.” During the inspection, waste boundary markers were observed indicating the limits of waste for the 9.21-acre footprint of the landfill. CORRECTIVE MEASURE IN PROGRESS: 15A North Carolina Administrative Code 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Facility Specific Permit Condition #11 of the Permit to Operate states: “Solid waste must be covered with 1 foot of suitable soil cover at least once per month or when the active area reaches 1 acre in size, whichever occurs first, or more often when necessary to prevent the site from becoming a nuisance or to mitigate conditions associated with fire, windblown materials, vectors or excessive water infiltration.” During the inspection, it was observed that the facility was in the process of applying soil cover to the waste exposed along the southern slope and toe of the eastern slope of the lower shelf of the inactive landfill. Some areas need additional cover and those areas were pointed out to Mr. McCorkle Jr. To achieve compliance, all side slopes must have adequate soil cover by December 27, 2016. A follow up inspection will be performed to confirm all exposed waste has adequate soil cover in accordance with the approved permit. CORRECTIVE MEASURE IN PROGRESS: 15A North Carolina Administrative Code 13B .0566(4) states: “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” During the inspection, it was observed that the facility was in the process of applying soil cover to the exposed waste along the southern slope and toe of the eastern slope of the upper shelf of the active landfill. The active area was less than one acre in size. To achieve compliance, all side slopes must have adequate soil cover December 27, 2016. A follow up inspection will be performed to confirm all exposed waste has adequate soil cover in accordance with the approved permit. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 4 The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 5 ADDITIONAL COMMENTS 1. This was a follow up inspection for the 6-21-16 comprehensive inspection to inspect the observed violations. 2. The waste slopes were vertical and it was discussed the finished side slopes need to be at 3:1 and all exposed waste needs to be covered. 3. Some erosion was observed in the roadway to the lower area. This was pointed out to Mr. McCorkle Jr. to make repairs and maintain the roadway.
