Resolved Sunset Hill Disposal Facility is in violation of 15A NCAC 13B .1406(6) in that engineered wood (plywood, OSB, and pressboard), painted pallets, and cardboard was observed in the unground stockpile. On October 21, 2016, Sunset Hill Disposal Facility provided photographs showing where the unapproved material was removed from the unground stockpile therefore, the violation is resolved. All photos were taken by Lee Hill on October 18, 2016 unless otherwise noted. 2. The facility is secured by gates and fencing. 3. The facility does not accept material from the public. 4. The access roads are constructed of all-weather material and were in good condition at the time of inspection. 5. Land clearing debris is ground into mulch and is used for beautification purposes. 6. Engineered wood, painted pallets and cardboard was observed in the unground stockpile. Engineered wood and painted pallets may not be ground into mulch. Photographs were provided by the facility on October 21, 2016 showing where the unapproved material was removed from unground stockpile. 7. Mulch is stored on the south side of the facility. It appeared that the mulch was stored outside the 50-foot property line buffer. Please ensure that all material is stored outside the 50-foot property line buffer. 8. It appeared that less than 6000 yds3 of material was on site at the time of inspection. 9. Surface water was adequately diverted from the operations and storage areas of the facility. 10. No onsite erosion issues were observed at the time of inspection. 11. Adequate access was provided around the ground and unground stockpiles for firefighting equipment. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
