PURPOSE OF SITE VISIT: Partial Inspection FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 STATUS OF PAST NOTED VIOLATIONS: 1. RESOLVED: 15A NCAC 13B .0510(c). Please see the ADDITIONAL COMMENTS Section of this report. OBSERVED VIOLATIONS: No new violations observed. ADDITIONAL COMMENTS 1. An inspection was conducted to review corrective measures to remove trees and undergrowth from the landfill cap as required by the Notice of Violation issued on March 30, 2016. At the time of the June 14, 2016 inspection the upper slopes of the landfill had been mowed and tree clearing was scheduled to include an in-place grinding of stumps to the surface of the cap. The compliance date was extended to August 26, 2016 for tree removal activities and work to confirm the edge of waste. 2. At the time of the September 14, 2016 inspection it appeared that most of the trees had been removed from the upper northern and eastern side slopes and the top of the landfill cap. Mowing was in progress on the top of the landfill. An additional tree removal operation is scheduled. 3. Tree removal is scheduled to continue in accordance with a long-term phased removal and maintenance plan that was submitted by Yancey County in a response letter on August 24, 2016. This plan supplements an earlier plan submitted to the Section in January of 2012. The maintenance plan includes documented quarterly inspections to prevent recurring compliance issues regarding maintenance of the landfill cap. Any stumps left from tree removal activities should be observed during the quarterly inspections. Additional measures to address the integrity of the cap may be required (the addition of soil to address subsidence, seeding, stump removal, mowing etc.). Future cap repairs may require prior review and approval by a permitting engineer. 4. Research of historical records and on-site work was done to accurately delineate the location of edge of waste. Permanent markers were installed. Some markers were viewed during the inspection. All markers will be looked at during the next comprehensive inspection. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
