Prepared by Duke Energy. September 2016. DIN 26746. In the letter Duke Energy requested a six (6) month extension to the notification requested in the Section’s letter entitled; Change to Approved Plans Request, Approval. October 2015. DIN 25155. In which the Section requested Duke Energy, notify the Section of the Facility’s determination whether to expand the landfill or enter into closure, by October 1, 2016. Since the Section’s letter of October 2015 Duke Energy has submitted to the Section a permit renewal application entitled; FGD Landfill Permit Renewal Resubmittal, Permit No.: 1809-INDUS, Marshall Steam Station, Catawba County, Terrell, North Carolina 28682. The Section considers Duke Energy’s permit renewal application for the industrial landfill as sufficient notification of Duke Energy’s intent to continue operation of the landfill. The Section is processing the renewal application for this industrial landfill in accordance with North Carolina General Statues NCGS 130A and North Carolina Administrative Code 15A NCAC 13B. Denial of the permit renewal application for the industrial landfill will require Duke Energy to implement a timely closure, issuance of the permit renewal will allow continued operation of Phase 1 and closure if desired, and as you are aware, a permit amendment application in accordance with NCGS 130A and 15A NCAC 13B .0500 will be required for any expansion (Phase 2) of this landfill.
