RESOLVED: 15A NCAC 13B .1402(f)(6), cited due to the existing yard waste operation occupying more than the maximum two acres of land. A map of the proposed site footprint of 1.22 acres is shown below. All processed and unprocessed material has been moved and consolidated into the indicated footprint. Thank you for your prompt response and diligent efforts to resolve this matter. OBSERVED VIOLATIONS: No new violations were observed during this inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. The facility was formerly named TP&N-79-003. Future notifications should be named YWN-79-003. 2. The site functions as a yard waste notification and wood waste treatment and processing site for the City of Eden. 3. Yard waste is collected at the site throughout the year. Typically, it is processed annually in the summer and sold as boiler fuel soon after processing. 4. Yard trash is primarily collected and brought to the site during the fall and is distributed into windrows and composted throughout the winter and spring. The resulting mulch is distributed to the public during the spring and summer months. 5. A concrete pad is located in the processed material storage area for use in loading and unloading trucks and other vehicles bringing material to and removing material from the site. 6. The total amount of processed and unprocessed material stored on the site is under the 6,000 cubic yard limit stipulated in 15A NCAC 13B .1402(f)(6). 7. The footprint of the site has been reduced to the area identified on the map shown below, which complies with the 2-acre size limit specified in 15A NCAC 13B .1402(f)(6). 8. The site has been leveled and berms added to eliminate water runoff to the northwest from the processed material storage area to the future equipment storage area. On the remainder of the site, storm water is directed into the existing storm water conveyance system. 9. Ensure that a temperature log is implemented for all processed materials and is available for review upon request. Temperatures should be monitored in each separate windrow. Composted material must maintain a temperature at or above 131° Fahrenheit for 3 days and be aerated as needed to maintain elevated temperatures in order to achieve pathogen reduction requirements as stated in 15A NCAC 13B .1406(10). 10. Ensure that accurate records of materials received at and removed from the site are maintained and are available for review upon request. Note that these records will be necessary to complete the required annual report for the facility. Final footprint of yard waste notification site.
