Jenny Flores, Privette Enterprises, Inc. Teresa Bradford, DEQ-Solid Waste Section STATUS OF PERMIT: The Yard Waste Notification approval letter was issued by the Solid Waste Section on July 1, 2015. The Yard Waste notification annual renewal is due by June 1st. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The Yard Waste Notification is for the collection and processing of land clearing debris and yard trash. The facility is to remain under 2 acres in size and process and store less than 6,000 cubic yards on a quarterly basis. 2. The facility also receives single hammered mulch to be reground. The tonnage for single hammered mulch is not included in the 6,000 cubic yards total. 3. Take measures to ensure that the 50-foot minimum buffer from yard waste activities and all property lines are being maintained. 4. Yard trash is defined in 15A NCAC 13B .0101(55) as solid waste resulting from landscaping and yard maintenance such as brush, grass, tree limbs and similar vegetative material. Continue to ensure that yard trash is taken to a facility that has been permitted by the Division of Waste Management to accept such waste. If the facility chooses to process yard trash, this material must be properly composted. 5. A gate is located at the entrance to the facility to prevent unauthorized access.
