The facility consists of a closed ash landfill, closed asbestos landfill, and a closed construction and demolition landfill. The portion of the landfill permitted to receive fly ash was closed in 2001. The portion of the landfill permitted to receive asbestos and construction and demolition debris has not received waste since before June 30, 2008. Closure documentation and closure certification has been submitted and received by the Solid Waste Section. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS Inspection of the Closed Ash Landfill (Area 1): 1. The access road was maintained in good condition. 2. Edge-of-waste markers were in place and maintained. Some of the Edge-of-waste markers have been placed across the perimeter road. Facility staff will confirm the boundaries of the ash and 3. The cover system appeared to be in good condition. The vegetative cover was mowed and in good condition. There was no erosion observed. Over-seeding will be performed in the Fall. 4. There was no ponding of water observed on the landfill surface. Slope drains and other storm water control structures appeared to be maintained in good condition. 5. Environmental monitoring records were reviewed during the inspection. Semi-annual sampling of groundwater, surface water, and leachate was conducted in August 25, 2015 and February 22, 2016 [Monitoring wells MW-1, MW-2, MW-3, MW-4, MW-5]. Inspection of the Asbestos Landfill (Area 2): 6. The access road was maintained in good condition. 7. Edge-of-waste markers were in place and maintained. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. A vegetative cover consisting of clover and grass was established and mowed. There was no erosion observed. 9. There was no ponding of water observed on the landfill surface. The access road was maintained in good condition. 11. Edge-of-waste markers were in place and maintained. 12. The landfill cover system was being maintained in good condition. A vegetative cover consisting of clover and grass was established and mowed. 13. There was no erosion observed. 14. There was no ponding of water observed on the landfill surface. Storm water control structures were maintained in good condition. Inspection of the Closed Ash Landfill (Open between 1984-1986): 15. The access road was maintained in good condition. 16. There was no erosion observed. There was no ponding of water observed on the landfill surface. Storm water control structures were maintained in good condition. 17. The cap of this unit is heavily wooded. Duke Energy routinely inspects the landfill unit for damage from fallen trees. Slope drains have been installed to reduce slope erosion. The tree removal was being done in accordance with the Marshall Landfill Vegetation Maintenance Plan which was submitted to the SWS on December 22, 2015 and approved by the SWS on January 13, 2016.
