Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS HISTORY 1. This fill site is composed of three properties: the NCDOT right of way along Hwy 301, the site originally submitted as BB Pierce Trucking Site and the area known as tract A which is apparently across River Rd from Basnight Building Supply. 2. The BB Pierce site submittal to the Division was dated June 9, 1995 and was deemed satisfactory in a letter from the Division to BB Pierce dated September 8, 1995. 3. The original submittal from the NCDOT to the Division was dated June 3, 1996 to allow filling of the 301 Hwy Right of Way and excluding the 25 foot setback to the BB Pierce property. The NCDOT had an encroachment agreement with BB Pierce. A letter accepting the NCDOT proposal was issued by the Division on June 13, 1996. 4. There was a revision to this plan submitted by the NCDOT on January 8, 1997 with a request to extend the fill area and to add an additional 10,000 cu yd of ash to the site. 5. There was a undated revision submitted by BB Pierce to the Division that called for filling the BB Pierce Property with 80,000 cu yd of ash and filling the NCDOT right of way with 7000 cu yd of ash. 6. There was a second undated revision submitted by BB Pierce to the Division that increased the ash fill on the Pierce property to 140,000 cy yd and increased the ash fill on the NCDOT right of way to 27,000 cu yd. 7. Ash was placed across the property line between the NCDOT right of way and the fill site formerly owned by Blackwell Pierce without a 25 foot buffer from each property line. This was allowed by the exclusion granted in NCAC .1704 (b) and was formalized by the Division to the NCDOT in a letter dated February 13, 1997. After this exclusion, the Division considered this to be a DOT submitted project, rather than a project submitted by BB Pierce. The NCDOT project number was 8.11373. 8. The generator of the coal ash is Roanoke Valley Energy, PO Box 351, Weldon, NC 27890. 9. The engineer was E.B. Grant, the Plumbline Corp. 121 Washington Ave. Weldon, NC 27890. Three tracts are referenced in the submittals, tract B appears to be the location of the building. 10. A Certification of Closure for the site identified as BB Pierce Trucking Site-Tract A was submitted to The Division on May 12, 1997 by Plumbline Corp. This certification stated that 140,000 cu yd of ash had been used on property shown on a plat showing property standing in the name of Mary Jane Arnold Crew and recorded in Plat Cabinet 5 Slide 121. Statement of Use of Coal Combustion By-Products was recorded in Book 1696 Page 256. Tract A appears to be on the north side of the intersection of River Rd and Hwy 301. 11. A Certification of Closure for The Right of Way project (project #8.11373) was submitted to the Division by Plumbline Corp. on April 30, 1998 and was recorded in Book 1743 Page 271 with the statement that 23,848 cubic yards of ash were used on the site. 12. The original submittal called for a warehouse to be located on the property. A building formarly used as the Basnight Building Supply is located on the site. W.H. Basnight & Co sold the property to the Town of Weldon on November 23, 2012. 13. The precise edge of the fill area is not known so no accurate determination of any other setbacks can be determined at this time. Most of the wood decking on previously covering the unpaved portion of the site appears to have been removed. No coal ash was observed in the bare areas however the soil was rutted from vehicle tires. Proper grading should be maintained to prevent ponding of water over the structural fill and minimize erosion. 2. If the unpaved portion of the structural fill is to be used for vehicular traffic, the area should be either paved or graveled and maintained to prevent exposure of the underlying coal ash.
