Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS On June 29, 2016, John Patrone met with Gordon Dively to conduct a comprehensive inspection of the Orange County C&D Landfill on Eubanks Road in Chapel Hill, Orange County. 1. The construction and demolition debris (C&D) landfill (68-04) is located adjacent to the Orange County Closed Municipal Solid Waste (MSW) Landfill (South Landfill), the Orange County Closed MSW Landfill (North Landfill), the Orange County Closed C&D Landfill (North Landfill), the Orange County Household Hazardous Waste (HHW) Collection Facility, and the wood grinding area (all encompass permit number 68-01). 2. The facility permit authorizes operation of the C&D landfill, Phase 1. 3. The facility is in operation Monday through Friday 7:00 am - 3:00 pm and Saturday 8:00 am - 12:00 pm. 4. The facility permit, operations plan, and site plan were discussed. 5. The facility is permitted to accept C&D material, inert debris, land clearing debris, and (used) asphalt from Orange County. 6. The following are certified personnel: a. Gordon Dively, Certified Manager of Integrated Solid Waste Management Systems, No. 874221, exp. 06/05/18 b. Thomas Scott, Certified Landfill Operations Specialist, No. LF-2010100, exp. 07/30/16 c. Lee Cloer, Certified Landfill Manager, Class taken June 2016 – awaiting certification 7. The facility maintains semiannual groundwater monitoring test records prepared by Draper Aden Associates, conducted by Sherrill Environmental, Inc., and analyzed by ENCO (Environmental Conservation Laboratories, Inc.). Records for May 12 – 14, 2015, November 10 – 12, 2015, and May 18 – 20, 2016 were verified. An exceedance is noted for each monitoring event. 8. Discuss whether to abandon groundwater monitoring well MW-210, which is no longer used, with Ervin Lane, SWS – Hydrogeologist, at 919-707-8288. 9. The facility maintains quarterly methane monitoring records. Methane monitoring is conducted by facility personnel. Records were verified for September 8, 2015 (3rd quarter), December 9, 2015 (4th quarter), March 10, 2016 (1st quarter), and June 2, 2016 (2nd quarter). No exceedance of the methane lower explosive limit (LEL) is noted. 10. The facility maintains quarterly hydrogen sulfide monitoring records that mirror the methane monitoring dates. No exceedance is noted. 11. Adjacent to the west external side slope there is a landfill gas (distribution) trench with eight passive vents. 12. The facility maintains records of the amount of material received. Throughput records were verified. Tonnage received from July 2015 through May 2016 is 6,427.87 tons. 13. The facility annual report (FAR) for July 2014 through June 2015 was received by the SWS dated July 16, 2015. The facility received 6,318.77 tons. 14. Six inches of soil cover is required weekly or when the disposal area exceeds one-half acre. 15. The facility maintains a weekly soil cover log. Records were verified for January through May 2016. The soil cover log statement “end of day” refers to Friday at ~ 3:00 pm. 16. The working face appeared small and compact. 17. Adjacent to the working face the facility maintains soil for cover, aggregate materials for roadways, and logs for firewood. 18. The facility maintains waste screening reports. A waste screening is required weekly or at > 1% by weight of the previous week’s total. Records were verified for January 2, 2015 through June 6, 2016. 19. The landfill cap, side slopes, and groundcover appeared adequate. 20. There was no indication of erosion or runoff. 21. Landfill edge of waste markers were observed. 22. The landfill monitoring wells observed appeared maintained. 23. The landfill sediment basin was observed. Mr. Dively stated that woody vegetation will be removed. 24. No windblown material was observed. 25. Mr. Dively stated that the landfill is mowed twice a year or as needed. The facility operations plan states that metal from mobile homes and trailers will be recovered for recycling at the landfill working face. Recyclable material may also be removed from incoming loads. Recyclable material will be brought to storage areas associated with permit 68-01. 27. The facility received two mobile homes for material recovery from July 2015 through June 2016. 28. The facility financial assurance has been received by the SWS. 29. Orange County has a Temporary Disaster Debris Staging Site (TDDSS, DS68-002) located adjacent to the active area of the C&D landfill, atop the undeveloped area allotted for Phases 2 and 3. 30. The New Hope Fire Department can be contacted to address an emergency at the facility. 31. The facility has an all-weather access road. 32. The facility is secured by a locked gate. The facility sign is located at the entrance to the scale house on Eubanks Road across from the C&D landfill. 33. The PTO expiration date is June 27, 2017. 34.
