CORRECTIVE MEASURES IN PROGRESS: 15 NCAC 13B .1402(g)(3) cited for failure to notify the Solid Waste Section annually. A yard waste notification was received by the Solid Waste Section on April 27, 2016. Corrective action is ongoing to reduce the stockpiled material to comply with the 6,000 cu. yd. maximum. A decision has been made to limit the scope of the city’s yard waste operations to one notification site, located at 1039 West Avenue, the site for which the notification was received. A follow-up inspection will be made on or around July 1, 2016 to determine whether compliance has been achieved. 2. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .1402(f)(6), cited due to the existing yard waste operation occupying more than the maximum two acres of land. City staff continue working to remove excess material and consolidate the site. A map of the proposed site footprint of 1.22 acres is shown below. OBSERVED VIOLATIONS: No new violations were observed during this inspection. ADDITIONAL COMMENTS 1. The facility was formerly named TP&N-79-003. Future notifications should be named YWN-79-003. 2. The site functions as a yard waste notification and wood waste treatment and processing site for the City of Eden. 3. Materials are primarily collected and brought to the site during the fall then processed and distributed into windrows, and composted throughout the winter and spring. 4. The resulting products, mulch and boiler fuel, are distributed to the public and to commercial entities during the spring and summer months. 5. Progress has been made in reducing the amount of processed material on the site. a. Some of the processed material will be used to level areas of the site that were heavily rutted as a result of using heavy equipment and trucks to remove material from the rain soaked site. b. Grinding of the unprocessed material is not planned until after the start of the new budget year on July 1, 2016. 6. The footprint of the site is continuing to be reduced to achieve the layout proposed on the site map below. 7. Some drainage issues were discussed during the inspection. Mr. Dishmon and Mr. Carter will contact Tony Gallagher, Composting and Land Applications Branch Head, to discuss suitable strategies for the site before proceeding. 8. Ensure that temperature logs are being maintained for all processed materials and are available for review upon request. 9. Ensure that accurate records of materials received at and removed from the site are maintained and are available for review upon request. Note that these records will be necessary to complete the required annual report for the facility. 10. The Solid Waste Section will conduct a follow-up inspection of the site on or around July 1, 2016 to observe the facility footprint and the amount of material stored at the site, and to determine whether compliance has been achieved. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
