CORRECTIVE MEASURES IN PROGRESS: 15 NCAC 13B .1402(g)(3) cited for failure to notify the Solid Waste Section annually. A yard waste notification was received by the Solid Waste Section on April 27, 2016. Additional work is required in order to develop a site plan that occupies a footprint of less than two acres and contains a stockpile of less than 6,000 cu. yds. of material. A second site is being considered for use as a composting facility solely for the leaves and grass clippings collected curbside from city residents. A follow-up inspection will be made on or around June 1, 2016 to observe progress made and to assist in the development of a long-term strategy for handling the city’s yard waste operations. 2. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .1402(f)(6), cited due to the existing yard waste operation occupying more than the maximum two acres of land. City staff have made considerable progress and will continue working to remove excess material and consolidate the site. A follow-up inspection FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 will be made on or around June 1, 2016 to observe progress made and to review the design of the site as it relates to the city’s operating parameters and operational requirements. OBSERVED VIOLATIONS: No new violations were observed during this inspection. ADDITIONAL COMMENTS 1. The facility was formerly named TP&N-79-003. Future notifications should be named YWN-79-003. 2. The site functions as a yard waste notification and wood waste treatment and processing site for the City of Eden. 3. Materials are primarily collected and brought to the site during the fall then processed and distributed into windrows, and composted throughout the winter and spring. 4. The resulting products, mulch and boiler fuel, are distributed to the public and to commercial entities during the spring and summer months. 5. Progress has been made in reducing the processed and unprocessed materials on the site. a. All of the boiler fuel has been removed, leaving the processed mulch that is offered to the public. A weekend sale to the public is being considered as a way to remove all processed material from the site in preparation for grinding over the summer. b. The unprocessed materials stockpile has been consolidated into a smaller area which now measures approximately 190’ long x 120’ wide x 15’ high. Consolidation work will continue. Grinding is not planned until after the start of the new budget year on July 1, 2016. 6. Mr. Dishmon and Mr. Carter indicated that the city is interested in designating a portion of the property as a temporary disaster debris storage site. This issue can be revisited when the final footprint for the yard waste facility is determined. 7. Due to time constraints, no records pertaining to the operation of the site were reviewed during the inspection. 8. Ensure that temperature logs are being maintained for all processed materials and are available for review upon request. 9. Ensure that accurate records of materials received at and removed from the site are maintained and are available for review upon request. Note that these records will be necessary to complete the required annual report for the facility. 10. The Solid Waste Section will conduct a follow-up inspection of the site on or around June 1, 2016 to observe the facility footprint and the amount of material stored at the site, and to review facility records. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
