The last record of annual notification is dated May 25, 2010. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 To achieve compliance, the City of Eden must submit a Yard Waste Notification to the Solid Waste Section on or before April 25, 2016 for review and approval. The notification must include a site plan that indicates a footprint that complies with the two-acre maximum area, containing a maximum volume of 6,000 cubic yards of stored material (both processed and unprocessed). Additional guidance about submitting Yard Waste Notifications, as well as the required forms, can be found at http://deq.nc.gov/about/divisions/waste-management/waste-management-permit-guidance/solid-waste- section/yard-waste. 2. 15A NCAC 13B .1402(f)(6), states that small Type 1 facilities must “occupy less than two acres of land.” The City of Eden is in violation of 15A NCAC 13B .1402(f)(6) due to the existing operation occupying more than two acres land. When observed on March 31, 2016, the site was estimated to occupy approximately 2.75 acres of land. To achieve compliance, the City of Eden must reduce the existing footprint of the facility on or before April 25, 2016, so that it occupies no more than two acres of land, while maintaining the required buffers, as set forth in 15A NCAC .1404(a)(1)-(9). ADDITIONAL COMMENTS 1. The facility was formerly named TP&N-79-003. Future notifications should be named YWN-79-003. 2. The site functions as a yard waste notification and wood waste treatment and processing site for the City of Eden. 3. Materials are primarily collected and brought to the site during the fall then processed and distributed into windrows, and composted throughout the winter and spring. 4. The resulting products, mulch and boiler fuel, are distributed to the public and to commercial entities during the spring and summer months. 5. The volume of stored material present on the site appears to be greater than the 6,000 cu. yd. maximum established in 15 NCAC 13B .1402(f)(6). Ensure that the volume of stored materials (both processed and unprocessed) on the site does not exceed 6,000 cu. yds. 6. Due to time constraints, no records pertaining to the operation of the site were reviewed during the inspection. Solid Waste Section staff will return within 30 to 60 days to examine temperature logs, quarterly records of cubic yards of material received and quarterly records of cubic yards of material removed. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
