PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. All photographs were taken by Susan Heim, Solid Waste Section, on March 9, 2016. 2. Facility is operating as an LCID landfill that accepts waste only from Sam Smith, Inc. company projects. 3. Access to the site is restricted by means of a gate which is kept locked when the facility is not in operation. 4. Proper signage was observed to the left of the entrance gate. 5. The facility ran a mining operation under permit # 79-25. Mr. Smith stated that mining operations on the site had been completed. 6. Phase 1 of the LCID landfill has been filled and closed, as indicated on the facility site plan. 7. The facility permit expired December 13, 2015; a renewal application was received by the Solid Waste Section on February 22, 2016 and was under review by Ming Chao, Permit Engineer (also present for inspection). 8. A decision was made post-inspection by the operator to withdraw the facility permit renewal application. Mr. Chao returned the application documents to the applicant and provided him with information and requirements for closing the LCID. 9. In response to my questions about the remaining fill area, Mr. Smith stated that the entire area, shown on the site plan as Phase 2, has been filled, closed and stabilized. It appeared, after walking the site, that Mr. Smith was correct in that the entire Phase 2 area had already been filled. Therefore, the updated site plan, to be submitted with the closure documents, needs to be revised to reflect the actual site conditions. Mr. Smith indicated that he would have a new site plan drawn up and submitted by April 1, 2016. This timeline has since been extended to May 1, 2016 by Mr. Chao, based on Mr. Smith’s request. 10. No edge of waste markers could be found on the site. Mr. Smith stated that he would have markers in place by April 1, 2016. This timeline has also been extended to May 1, 2016 by Mr. Chao, based on Mr. Smith’s request. 11. During the inspection, Mr. Smith stated that the fill area had been covered with four feet of soil cover. 12. As closure proceeds, based on the requirements set forth in 15A NCAC 13B .0566(5), (7) and (10), ensure that: a. the woody growth on the side slopes and around the perimeter of the fill area are removed and the areas surrounding them stabilized; b. the side slopes are graded to allow controlled surface water runoff and no ponding results at the base of the slopes; c. the side slopes have adequate vegetative cover. 13. Ensure that the small amount of water observed on top of the fill are is diverted so that it is not impounded over the waste.
