Bader, PE, LEED AP County Engineer Harnett County Engineering and Facilities Management PO Box 2773 Lillington, NC 27546 SUBJECT: Notice of Violation Compliance Inspection Report Dunn-Erwin C&D Landfill Permit # 4302-CDLF-1998 449 Daniels Road, Dunn, NC 28334 Harnett County Dear Ms. Bader: On June 8, 2016, Liz Patterson and Drew Hammonds, representing the State of North Carolina, Division of Waste Management Solid Waste Section (Section), inspected the above referenced facility for compliance with North Carolina solid waste statutes and rules. The following violation(s) were noted: A. 15A NCAC 13B .0566(14), “Leachate shall be properly managed on site through the use of current best management practices.” Leachate was observed flowing down the slope behind the yard waste storage area and the slope of the active LCID area into the perimeter drainage channel and into a drain on the south side of the LCID that reportedly drains into a wetland area. B. Per 15A NCAC 13B .0542(f)(1), states “(f) Cover material requirements. (1) Except as provided in Subparagraph (3) of this Paragraph, the owners and operators of all C&DLF units must cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and at least once weekly. Cover must be placed at more frequent intervals if necessary to control disease vectors, fires, odors, blowing litter, and scavenging. A notation of the date and time of the cover placement must be recorded in the operating record as specified in Paragraph (n) of this Rule.” 4302-C&DLF-Dunn Erwin Notice of Violation Page 2 of 3 June 16, 2016 State of North Carolina | Environmental Quality | Waste Management 1646 Mail Service Center | 217 West Jones Street | Raleigh, 27699-1646 919 707 8200 The exposed waste including the active working face and south side slope was in excess of ½ acre at the time of this inspection. Based upon the foregoing, upon receipt of this Notice of Violations, Harnett County shall come into compliance with all requirements of the regulations in 15A NCAC 13B .0566(2) and 15A NCAC 13B .0542(f)(1) by completing the following: 1. Stop the flow of leachate from the LCID landfill and Yard Waste storage area right away, cover the waste and grade the area to allow for positive drainage. 2. The facility operator must collect samples of the leachate that is pooled up in the yard waste storage area, in the perimeter drainage channel and the wetland area where the discharge point is located. A TCLP for the 8 RCRA metals should be performed on the samples collected. Results from the testing should be submitted to Ervin Lane, Compliance Hydrogeologist, 1646 Mail Service Center, Raleigh, NC 27699-1646 for review. 3. Make repairs to the eroded areas of the C&DLF where the exposed waste and leachate seeps were observed and maintain the slopes to ensure waste is properly covered. All corrective measures must be completed within 30 days’ receipt of this notice of violations. A follow up site inspection will be conducted after 30 days have passed to ensure that the corrective measures have been completed to bring this facility into compliance. The violation(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. In addition to the violation noted above, please note that items #6, #7, #8, #12, #13, and #17 through # 30 on the inspection report required additional action on behalf of the facility in the next 30 days to ensure compliance is maintained at this facility. Should these items not be addressed in that time frame, the facility will be subject to future enforcement action(s). Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct a follow-up inspection to verify that the facility has completed the requirements of this Notice of Violation.
