The Solid Waste Section (SWS) appreciates your cooperation of closing down the landfill accordingly and will cease permit reviewing processes today. During the period of site closure, if you have any questions or concerns please contact me or Susan Heim at 336-776-9672. Could you please also inform the SWS how you want us to handle the Permit (renewal) Amendment Application document of the landfill received on February 22 and 24, 2016. Smith, Jr. has sold the landfill and mining/borrow pit to the Osborne brothers who own the rest of the farm there at these sites and they do not wish to have the landfill and mining permits renewed because they have no use for these; therefore, all parties wish to close same permanently. The farm is used for cattle farming. I understand that certain items have to be done that were observed such as debris at these sites has to be removal and removal of small saplings and trees from landfill side slopes and site corner stakes needs surveying and permanent stakes or posts installed. These areas can be grassed over after clean-up. It is noted that after these things are completed, your office is to be notified for inspection. Then your office will issue the permanent closing procedures for all parties to complete. In future, the new owners will still be responsible for keeping these sites clean and compliant and the State will randomly inspect these sites even though closed permanently. Smith, Jr., Inc. LCIDLF, 79J-LCID Dear Mrs. Richardson: Good morning. I was informed by my colleague this morning that Sam W. Smith, Jr., Inc. sold the property of the Sam W. Smith Jr. LCIDLF, Solid Waste Management Permit # 79J-LCID to a third party. This information is based on the message that you left on the Susan Heim’s voice mail on Friday, March 18, 2016. Upon receiving this email message, please - Timely reply this e-mail message to confirm your intention to withdraw the permit amendment application. 3 - Provide the schedule to proceed and complete landfill site closure according to the permit conditions, landfill site closure recordation requirements, and NC Solid Waste Management Rule 15A NCAC 13B .0566(5), (6), & (7). - Inform the Solid Waste Section how to handle the permit amendment application (DIN 25659 & 25665) of the landfill received on February 22 and 24, 2016. It is Sam W. Smith Jr., Inc. responsibility, even if the landfill is closed, to complete the requests stated in the March 14, 2016 letter (DIN 25750) including: 1. The installation and properly maintenance of the waste edge markers according to latest site survey results. 2. The removal of small trees or saplings from landfill side slopes. Additionally, wastes including tree limps and leaves and stockpiled soil/inert debris that were observed at the landfill facility during the site visit/audit on March 10, 2016 must be properly disposed of or removed from the landfill facility. The Solid Waste Section will not refund Sam W. Smith Inc. the permit application fee in the amount of $500.00 dollars which was received on March 15, 2016. Upon receiving your e-mail message or the written document to confirm the intention of the landfill site closure, the Solid Waste Section will cease the permit review processes and initiate the site closure procedures including the second site visit to verify the completion of a site closure and send you the document(s) that assist you in properly close of the landfill site.
