A Construction and Demolition (C&D) landfill was constructed on top of the old MSW unit and then closed and capped in 2004. 1. The facility is secured by locking gates located on Old Smithfield Rd. 2. Access roads were of all weather construction and maintained in good condition. 3. The landfill cap was covered in a good layer of native vegetation which is mowed several times per year. At the time of this inspection, the vegetation was mowed to an acceptable height which allowed for a visual inspection of the cap. 4. Slope drains, drainage channels, and stormwater control measures appeared to be in good condition and functioning properly. 5. Semi-annual water quality monitoring is being performed by CDM Smith Inc. 6. Methane gas vents were installed during closure of the unlined MSW landfill, and some were converted to landfill gas recovery wells in 2011. 7. Digital photographs were taken during this inspection. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
