OBSERVED VIOLATIONS 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time." At the time of this inspection waste appears to have been pushed close to the tree line by phase VI. Some areas of the eastern side slope were not compacted. The waste needs to be moved away from the tree line and properly compacted, covered, and Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA OepaN W Emironm l pu.lily Solid Waste Section sloped. 15A NCAC 13B .0566 (3), "All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first." At the time of this inspection, waste at the working face along the eastern edge of the LCID had been pushed into the tree line and has not been covered by the rule and the area appeared to be larger than one acre. Ensure that the waste has been moved away from the tree line, covered, and properly sloped. 15A NCAC 13B .0566 (7), "Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire -fighting vehicles." At the time of this inspection the access road along eastern edge of the LCID did not have all-weather construction and was not being maintained to allow access by vehicles transporting waste, Department staff, and fire -fighting vehicles. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: This was a compliance inspection visit. 1. No Hazardous or Liquid Waste was added to the Facility Entrance signage since the last inspection. 2. The facility is secured by a locking gate at the entrance off Old Battleboro Road and at the location of LCID. 3. All Edge of Waste markers were in place. 4. No leachate breakouts were observed. 5. Waste is limited to (permit). Painted concrete, metal, and treated wood were observed. This unacceptable waste should be removed and disposed of properly as it is observed. 6. A large influx of storm debris occurred due to a tornado in the area last year, and it appears that waste filled the LCID phase VII area. The facility is encouraged to complete the requirements to open phase VI, currently a tree lined area to the East of Phase VII, as part of the effort that must be undertaken to complete an access road of all- weather construction between the working face of the western edge of Phase VII and Phase VI treelined area. 7. Construction of Phase VI had not begun within 18 months of the date of issuance of the current permit. Therefore, the City will be required to submit a re -application. 8. Any changes to the facility and or operations must be approved by Permitting prior to implementation. Approval for changes must be received in writing from permitting branch or Section staff. To the Northeast area of the permitted site a large pile of leaf litter was observed stockpiled. Please include this area in your renewal if the City would like to continue storing waste outside the disposal footprint. 9. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days' receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed. Digital photographs were taken during the inspection.
