LCID Landfill July 2023 Cumberland County, NC Revised December 2023 Page I 1 Autry Grading, Inc. owns and operates a sand pit under permit number 26-32, located at Doc Bennett Road, north of Interstate 95 near the intersection of Radar Road in Hope Mills, Cumberland County, North Carolina, as designated by Deed Book 5334 on Pages 656-659 (Figure 1). This site is permitted for sand mining with erosion control plan approved by NCDEQ. The mining permit is 34.25 acres. The LCID landfill boundary and waste footprints are shown on Drawing CI01. Currently, the footprint of the LCID landfill is approximately 6.54 acres. The proposed maximum extent of the landfill is 13.08 acres. The continuing development does not impact any additional properties. This parcel is zoned M(P) (Planned Industrial) and is approved by the Cumberland County local government for the next 5-year phase via an approved Conditional Use Permit. This site meets all requirements of the Cumberland County Zoning Ordinance. The Cumberland County local government approval is in Appendix B. In 2023, Autry Grading retained Anderson Engineering to renew the 5-Year Permit Application to continue processing and disposing of land clearing materials such as stumps, brush, limbs, rock, brick, and block located inside their permitted Arm Pit Mine. Autry Grading is the only entity permitted to use this disposal site. This site is not permitted for public disposal of any kind of waste. LCID Landfill July 2023 Cumberland County, NC Revised December 2023 Page 1 2 'k-R., PHASE OF OPER,XnONS 2, 5 Y' A[ .11 1 _.L An individual permit is required by Rule .0563 for the construction and operation of a Land Clearing and Inert Debris landfill when the facility is to be operated for the disposal of land clearing waste, inert debris, untreated wood, and yard trash. Operations must be consistent and in compliance with the local government solid waste plan as approved by the Division of Solid Waste Management and the disposal area is greater than two acres in size. Individual permits for LCID landfills shall be issued for not more than five years. The application for 5-Year permit renewal requires two cross -sections of each operational areas that show the current elevations, proposed elevations, the proposed elevation at the end of the 5-year phase of operation and the proposed final elevations. The excavation drawing must show the separation to groundwater and bedrock at least four feet. Current filling operations is shown on Drawing CI01. Phase 1 has been filled and not accepting any more waste at this time. Permanent seeding has been established and is being maintained. The Owner reserves the right to resume filling Phase 1 at a later date. A portion of Phase 2 has been filled with LCID waste. The 5-year landfill development shown on Drawing C102 is based on the average of the previous five years disposal rate at approximately 11,000 cy per year. The operator plans to fill Phase 2 to the west end. Commencement of Phase 3 is not anticipated until the year 2028. Cross -sections of the landfill are shown on Drawing C103. The cross -sections were prepared by Anderson Engineering & Associates, P.A. based on the site survey conducted on May 31, 2023 and information provided by Joyce Engineering, Inc. The proposed final elevations are shown on Drawing C-104. This plan was originally created by Joyce Engineering and updated during this application by Anderson Engineering & Associates, P.A. Five test pits were excavated on the pit floor on April 6, 2011 to investigate seasonal high groundwater elevation in the pit. Each pit was excavated to a minimum of six feet below the surface. Each pit observed for a few hours for seepage and determined dry, i.e. no groundwater was identified to seep in the excavated pits; therefore the seasonal high groundwater level is six feet or more below the current ground surface elevation. From the field observations of the excavated pits, separation to the seasonal high ground water is greater than the minimum of four feet. LCID Landfill July 2023 Cumberland County, NC Revised December 2023 Page 1 3 It is proposed that the landfill is divided into four phases. Phase 1 and 2 are permitted and active at this time. These areas are approximately 3.27 acres each and hold a gross volume of +/- 146,200 cy of waste. Phase 1 is partially seeded and permanent grass has been established. Phase 2 is partially seeded except for one acre of active use. The active area has temporary erosion control measures in place to prevent sediment from leaving the site. There is an existing active soil access road leading to the existing active areas of the landfill and mine. At this time no further waste will be added to Phase 1. The Owner reserves the right to resume filling Phase 1 at a later date. Permanent seeding has been established and erosion control measures have been put in place. Phase 2 adjoins Phase 1 and currently holds a gross volume of +/- 69,600 cy of waste. It will continue to be developed in a southwesterly direction. Phase 2 has a remaining life expectancy of approximately two and one half years with an available net fill volume of +/- 65,800 cy, based on the previous two years disposal rate of 11,000 cy per year. Phase 2 shall be covered with soil monthly, or when the active area reaches one acre in size, whichever occurs first. All non -active areas will have temporary seeding and temporary slope drains, swales, and diversions to carry stormwater to the existing and proposed retention basins to prevent sediment from leaving the site. When Phase 2 reaches capacity, permanent seeding and erosion control measures will be established. Phases 3 and 4 will continue north of Phase 2 and be filled in a southwesterly direction in the same manner as Phase 2. Erosion control will continue to be ongoing with only one acre being active at a time. The remaining life expectancy of Phase 3 and 4 landfills are approximately eight and one half years, assuming the disposal rate of 11,000 cy per year. During all phases of this development, the Autry Grading will maintain a minimum four -foot separation between the seasonal high water table and the bottom of the filled areas. (Information regarding the seasonal high water table was submitted with the original application.) As this landfill expands, care will be taken to ensure a continued four -foot buffer between the bottom elevation of the waste and seasonal high water table. All slopes shall be no more than 3:1 and filled areas will be covered with at least one foot of earthen material available on -site. No filling will take place less than 100 feet in any direction from the property lines or within the wetlands. Erosion will be controlled in accordance with the previously approved Erosion Control Plan. Special care will be taken to protect waters of the US including jurisdictional wetlands on -site from any impact. Wetlands are delineated on the Current Conditions Sheet C101. F.I.R.M. Map 3720043400J dated January 5, 2007, shows the parcel is located within Zone X, which is outside the 0.2% annual chance flood plain. This site does contain 6.90 acres of wetlands as shown on the plan included on Drawing C101. The southwest property is the Big Sandy Run. All runoff within the facility boundary is directed toward specified drainage areas, where it will be treated before being discharged. Waste shall not be disposed of in or within 50 feet of the delineated wetlands area. An access road has been established and is maintained around the waste boundary for all types of vehicles including emergency and fire -fighting vehicles and equipment. At this time, Autry Grading, Inc. has no plans to request service for waste outside its own needs. Public disposal of any waste is not allowed under the LCID permit. Minor changes to the 2017 permitted Operations Plan have been made for this 5-year permit renewal application. The revised 2022 Operations Plan is included in Appendix D. The updated sections include 3.0, 4.0, and all subsections contained within. An estimate of the quantity of waste to be disposed in the LCID disposal area is provided in Table 1. The estimate is based on the airspace provided by proposed base and final grades, and the current ratio of incoming waste to the in -place volume of waste and the amount of cover soil in the fill. Allowances of the airspace occupied by the cap were made. The estimate for airspace was determined using AutoCAD. 1. Estimate for the total airspace in cubic yards considered to be the total volume between the bottom grades and the top of the cap system. 2. Estimate the volume (cubic yards) occupied by the closure cap. 3. Subtract the cap volume from the total airspace volume to estimate the net airspace available for waste disposal. 4. Assume a 9:1 waste to soil ratio. 5. Assume incoming waste to the in -place volume of waste and the amount of cover soil in the fill. 6. Annual disposal volume is estimated at 16,000 cubic yards due to hurricane debris within the last five years. The next five year disposal volume is expected to return to the normal estimated volume of 11,000 cubic yards and to increase at a rate of 2% per year. A letter from the local government stating the site meets local zoning ordinance is included in Appendix B. Untreated leachate should not leave the limits of the landfill. These areas need to be repaired right away to prevent offsite migration of leachate. The exposed waste of the working face appeared to exceed one acre at the time of this inspection. Facility staff must ensure that waste is covered as required by the above rule. (5) 120 calendar days after completion of any phase of disposal operations, or upon revocation of a permit, the disposal area shall be covered with a minimum of one foot of suitable soil cover sloped to allow surface water runoff in a controlled manner. The Division may require further action in order to correct any condition which is or may become injurious to the public health, or a nuisance to the community. Exposed waste was observed in Phase 1 and Phase 2 at the time of this inspection. Additional soil may be necessary in these areas to ensure compliance with the rules. (6) Adequate erosion control measures, structures, or devices shall be utilized to prevent silt from leaving the site and to prevent excessive on site erosion. Erosion was observed on the side slope of the inactive area of the landfill. Areas that are eroding must be repaired as soon as practical once they are observed by facility staff. (7) Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of landfill development. The phases that have been completed must be repaired, seeded and mulched to establish ground cover. 3. Permit No. 26M-LCID-2012 Attachment 3, Part 1 General Facility - 14. Excavation, grading and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical foot (3:1) unless previously approved by the Section. The side slope of the active working face was in excess of 3:1 at the time of this inspection. 4. 15A NCAC 13B .0563 (3) An individual permit is required, except for landfills subject to Item (5) of this Rule, for the construction and operation of a Land Clearing and Inert Debris (LCID) landfill when: (a) The facility is to be operated for the disposal of land clearing waste, inert debris, untreated wood, and yard trash. Operations must be consistent and in compliance with the local government solid waste management plan as approved by the Division of Solid Waste Management, and (b) The total disposal area is greater than two acres in size. Unacceptable was consisting of plastic pipe, chain link fence, plastic and what appears to be "drillers mud". Unacceptable waste must be removed as it is observed and disposed of properly. ADDITIONAL COMMENTS 1. Facility permit issued July 17, 2018 and expires on July 17, 2023. 2. Operational plans shall be approved and followed as specified for the facility. 3. The sign at the entrance sign at the entrance to the facility was correct. The gate at the entrance was unlocked at the time of this inspection. 4. An attendant shall be on duty at all times while the landfill is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes. 5. Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells. The working face was vertical and long at the time of this inspection. Required per the approved plan is a 25-foot gravel access road around the entire perimeter of the landfill. The road is severely eroded and washed out along the west and south side of the landfill and must be repaired and maintained in accordance with the rules and permit conditions for this facility. 8. Permit No. 26M-LCID-2012 Attachment 3, Part 1 General Facility - 8. The edge of the waste footprint for all disposal units must be identified and maintained with permanent physical markers. Edge of waste markers must be replaced or installed. There were markers for "Cells" but not Edge of Waste. 9. Revisions to the design or operation of the facility or changes to the facility service area must be submitted to the Section for review and approval prior to the implementation of any changes. Drillers mud must not be accepted in this facility without being analyzed for contaminants and properly solidified first. 11. Remove all unacceptable waste right away. 12. Section Staff did not inspect the waste cells during inspection but wanted to discuss a path to resolving current violations. 3. Mr. Knowles indicated drillers mud will no longer be accepted at the site and the hauler which brought the loads, mentioned during last inspection, was not allowed back anymore. 4. The current working face is a vertical wall of waste. Backing up to edge and dumping waste over then pushing soil on top is not how the landfill should be constructed nor its design to operate. Keep working face below an acre and compacting once reaches thirty days or a full one acre in size, then covering with soil and building upon that, is correct way. 5. Future of the LCID was discussed in regards to operating according to the rules. Mr. Knowles is considering just hauling his waste to another approved site and shutting this one down but is unsure at this point. 6. During the site visit, it appeared that some sloping and soil cover addition had occurred. 7. Andrew Hammonds stressed the importance of covering and layering waste with soil monthly or when working face reaches one acre in size, as the rules states, but also to reduce risk of fire in the LCID in the future and to conserve space. 8. Phase 1 needed additional soil cover, which some has been added, but needs vegetation established for long term management and to prevent soil erosion. It is recommended a mixture of an Annual grass, Rye, and Warm Season Perennial grasses, such as Bahia grass, be used once sloping and soil cover is completed. Be vigilant in repairing eroded areas as they occur. 9. Site has a lockable gate and a sign with permit number, contact info etc. LCID is not open to the public but still is required to have signage stating, "...that no hazardous waste or liquid waste can be received at the facility." Arm Mine Cumberland County — Permit No. 26-32 for the operation of a Sand Mine Which shall provide that the usefulness, productivity, and scenic values of all lands and waters affected by this mining operation will receive the greatest practical degree of protection and restoration. MINING PERMIT EXPIRATION DATE: August 22, 2022 Page 2 In accordance with the application for this mining permit, which is hereby approved by the Department of Environment and Natural Resources, hereinafter referred to as the Department, and in conformity with the approved Reclamation Plan attached to and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected by the permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive the expiration, revocation, or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at the designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Whenever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Modifications October 15, 1992: This permit has been modified to change the buffer requirements along the north, east, and south sides of the site to 20 feet and to allow the perimeter to be mined at a 2 foot horizontal to 1 foot vertical slope. April 14, 2000: This permit has been transferred in its entirety from Crowell Construction, Inc. to APAC-Carolina, Inc, Crowell Constructors Division. February 22, 2002: This permit has been transferred in its entirety from APAC-Carolina, Inc., Crowell Constructors Division to Autry Grading, Inc. Additionally, this permit has been renewed and modified to increase the affected acreage to 34.25 acres, as indicated on the mine map dated November 12, 2001 and the Site Plan and Erosion & Sedimentation Control materials submitted to the Department December 10, 2001. Page 3 August 22, 2012: This permit has been modified to increase the permitted acreage to 52.93 acres and decrease the affected acreage to 29.2 acres, as indicated on the mine map last revised July 13, 2012. This modification includes a change in excavation area and a change in reclamation plan to allow for a 13.1 acre LCID facility onsite. The increase in permitted area is a result of better mapping of the site, as well as the addition of existing haul/access roads and required buffers along the creep within the permitted boundary. Expiration Date This permit shall be effective from the date of its issuance until August 22, 2022. Conditions This permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and to the following conditions and limitations: {OPERATING CONDITIONS: A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. B. Any stormwater runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Management Commission. It shall be the permittee's responsibility to contact the Division of water Quality to secure any necessary stormwater permits or other approval documents. 2. A. Any mining process producing air contamination emissions shall be subject to the permitting requirements and rules promulgated by the N.C. Environmental Management Commission and enforced by the Division of Air Quality. B. During mining operations, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. 3. A. Sufficient buffer (minimum 100 foot undisturbed) shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. B. Any mining activity affecting waters of the State, water of the U. S., or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission. Page 4 4. A. Adequate mechanical barriers including but not limited to diversions, earthen dikes, check dams, sediment retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the affected land. B. Mining activities, including the installation and maintenance of the approved detention pond and all erosion and sedimentation control measures, shall be conducted as indicated on the mine map last revised July 13, 2012 and the supplemental information received February 21, 2012, May 30, 2012, and July 19, 2012. 5. All mine permit boundaries affected area boundaries (29.2 acres) shall be permanently marked at the site on 100-foot intervals unless the line of sight allows for larger spacing intervals. 6. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erosion. 7. The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 8. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public thoroughfares whenever practical to screen the operation from the public. 9. Sufficient buffer (minimum 50 foot undisturbed) shall be maintained between any excavation and any mining permit boundary or right-of-way to protect adjacent property. 10. A physical barrier consisting of a fence or earthen berm, etc., shall be maintained around the perimeter of any highwall. 11, A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum Page 5 products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" tin addition to those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971): 1. on -site generated land clearing debris 2. conveyor belts 3. wire cables 4. v-belts 5. steel reinforced air hoses 6. drill steel D. If mining refuse is to be permanently disposed within the mining boundary, the following information must be provided to and approved by the Division of Land Resources prior to commencement of such disposal: 1. the approximate boundaries and size of the refuse disposal area; 2. a list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; 4. verification that the refuse will be disposed at least 4 feet above the seasonally high water table; and 5. verification that a permanent vegetative groundcover will be established. E. The disposal of demolition landfill material at the site shall be in accordance with Solid Waste Permit No. 26M-LCID, and any subsequent approved modifications to said permit, issued by the Department of Environment and Natural Resources, Division of Waste Management. 12. An annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 13. The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit and any approved revisions to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. 14. The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a $104,600.00 surety bond and a $36,400.00 surety bond (totaling $141,000.00, and of which $118,400.00 is required for this site), is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. Page 6 15. A. Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. B. Pursuant to N. C. G. S. 70 Article 3, "The Unmarked Human Burial and Human Skeletal Remains Protection Act, " should the operator or any person in his employ encounter human skeletal remains, immediate notification shall be provided to the county medical examiner and the chief archaeologist, North Carolina Division of Archives and History. Page 7 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 1. The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, or likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: Provided further, and subject to the Reclamation schedule, the planned reclamation shall be to fill 13.1 acres of mined area with demolition landfill material according to Solid Waste Permit No. 26M-LCID, and any subsequent approvals to said permit, sufficiently cover the landfill material, and properly regrade and satisfactorily revegetate any remaining disturbed areas. 2. The specifications for surface gradient restoration to a surface suitable for planned future use are as follows: gm: A. All the final perimeter sideslopes shall be graded to a 3 horizontal to 1 vertical or flatter slope. B. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled and smoothed. C. Compacted surfaces shall be disced, subsoiled or otherwise prepared before revegetation. D. No contaminants shall be permanently disposed of at the mine site. On -site disposal of waste shall be in accordance with Operating Condition 11 A through D. E. The disposal of demolition landfill material shall be in accordance with Solid Waste Permit No. 26M-LCID and any subsequent approvals to said permit. A minimum of two feet of cover shall be applied prior to final revegetation and closure of the landfill. F. The affected land shall be graded to prevent the collection of noxious or foul water. 3. Revegetation Plan: After site preparation, all disturbed land areas shall be revegetated as per the specifications approved by Carrie Mitchell, PE, and shown on the Mining Development Construction Details (Sheet 3) last revised July 13, 2012 or per the following: Permanent Seeding Specifications Dates Species Rate, Lbs/Acre February 15 —April I Kobe Lespedeza 10 Bahiagrass 50 Redtop 1 Winter rye (grain) 15 April 1 —July 31 Common Bermuda 50 August 1 — October 25 Lespedeza (unscarified) 30 German millet 40 October 25 -- February 15 Rye (grain — temporary) 120 Page 9 Soil Amendments Lime- 2000 lbs/acre or follow recommendations from a soil test. Fertilizer- 1000 lbs/acre 8-8-8 or 10-10-10, or follow recommendations from a soil test. Mulch- All seeded areas shall be mulched using small grain straw at a rate of 2000 lbs/acre and anchored appropriately. Whenever possible, disturbed areas should be vegetated with native warm season grasses such as switch grass, Indian grass, bluestern and gamma grass. In addition, the permittee shall consult with a professional wildlife biologist with the N.C. Wildlife Resources Commission to enhance post -project wildlife habitat at the site. 4. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Final reclamation, including revegetation, shall be completed within two years of completion or termination of mining. This permit, issued to Crowell Construction, Inc. June 22, 1992, modified October 15, 1992, transferred in its entirety to APAC-Carolina, Inc., Crowell Constructors Division April 14, 2000, and simultaneously renewed, modified, and transferred in its entirety to Autry Grading, Inc. on February 22, 2002 is hereby renewed and modified this 22nd day of August 2012 pursuant to G.S. 74-52. la Tra E. When the landfill ceases to be used as such, the property owner is the responsible part to ensure the site is covered, grassed and aesthetically pleasing. In addition, the property owner is strongly encouraged to plant trees of the type(s) that do not grow to significant heights. Advisories: 23. The applicant is advised to consult an expert on wetlands before proceeding with any development. There may be wetlands located in the project area that are subject to the permit requirements of Section 404 of the Clean Water Act. To avoid a violation of federal and/or state law, it is recommended the developer contact the Office of the Army Corp of Engineers or hire an environmental consultant to identify and delineate any wetlands in the project area prior to construction. A Section 404 permit will be required if the applicant needs to fill wetlands and the permit must be obtained prior to any construction on this site. 24. The owner/developer is responsible for ensuring easements which may exist on the subject property are accounted for, not encumbered and that no part of this development is violating the rights of the easement holder. 25. Autry Grading LCID Landfill Table of Contents Page I ii Cumberland County Revised July 2023 Revised December 2023 1 Purpose. - This report was prepared on behalf of Autry Grading, Inc. in accordance with North Carolina Solid Waste Management Regulations, 15A NCAC 13B, Rule .0566. Autry Grading will develop this property as a landfill for Land Clearing and Inert Debris (LCID). The site was formerly known as Arm Pit Mine (Mining Permit No. 26-32). The intent is to reclaim the site with land clearing and inert debris, as shown on the plans enclosed, and to demonstrate compliance with the appropriate application requirements. This Operations Plan contains information pertinent to the operation of the LCID landfill. The document will provide the Owner and Facility Operator direction to properly operate and comply with the laws and regulations as defined in the rules. In addition, this document describes systematic use of disposal area, operation, and orderly development during the life of the facility and closure of the landfill. Included with this information are drawings and accompanying text, which illustrate existing conditions, waste placement and daily operations, waste management, buffer zones, and soil borrow procedures for the land clearing and inert debris landfill. 12 Facility Location and Description: The Arm Pit Mine (Mining Permit No. 26-32) is owned and operated by Autry Grading, Inc. located south of Fayetteville Regional Airport, between the airport and Interstate 95. The property access is from Doc Bennett Road and the site boundary and disposal are shown on Drawing CIO]. In general, surface water flow is towards the southwest, which eventually flows to Big Sandy Run Creek, a tributary to Rockfish Creek, located to the south of the landfill property. Presently, the footprint of the LCID Landfill is about 6.54 acres. Proposed maximum extent of the landfill is 13.08 acres. The LCID meets the minimum buffer requirements required by siting criteria in 15A NCAC 13B. 0564(9). The projected use after completion of the LCID landfill will be open space. Autry Grading owns and operates the LCID landfill. Their office is located at 5124 US Highway 301 South, in Hope Mills, NC 28348. L D E . w✓ M EN T P.. .ae' A 2.1 Existing Conditions The Arm Pit Mine is currently operating under Permit No. 26-32. The mine was originally permitted in 1992 for the operation of sand mine. Current Conditions on Drawing CIO] show the limits of the existing mine area, current topography, entrance and access roads, property lines and buffers, and other site features. 2,2 Pnoposed Site Development The LCID footprint, shown as phases, is on Drawing CIO]. The Five -Year Phase for the continuing of the LCID area is shown on Drawing C102 and Final Grading Plan on Drawing C104. No horizontal expansion from the sand mining area is proposed. Within the LCID disposal unit, clean wood waste will be collected and ground for use as mulch. LCID Landfill Revised July 2023 Cumberland County, NC Revised December 2023 Page 1 2 .1 Waste Acceptance Criteria This facility collects stumps, limbs, leaves, yard waste, concrete, brick, block, non -treated wood, and other wastes specifically approved by the Division of Waste Management, Solid Waste Section. This facility shall only accept those solid wastes that it is permitted to receive (15A NCAC 13B /0565(a)(8)(C)). The LCID waste shall be placed to a smallest area feasible and compacted as densely as possible. The Division of Solid Waste may approve other wastes for disposal at the LCID disposal area. Requests for approval shall be submitted in accordance with Division policy. Inert debris waste accepted at the site shall be placed within the permitted landfill footprint unless it is being processed for recycling or reuse. Inert debris waste shall not be placed as beneficial fill as defined in Rule .0562 within the site buffer areas or elsewhere on the property unless stated in the site permit. Service3.2 e This facility will mainly accept waste from Cumberland, Hoke, Harnett, Robeson, and Johnson Counties. In rare circumstances, Autry Grading may acquire bids from counties, other than those stated above, that will require the use of the LCID. Under normal operation circumstances, this facility has an average disposal rate of 11,000 cy per year. However, during this past five year period, due to several hurricanes and an atypical amount of disaster debris, this facility had an average disposal rate of 16,000 cy per year. Once the disaster debris was cleaned up, the facility resumed normal operating procedures. The continuing development does not impact any additional properties. No hazardous or liquid waste is accepted. The landfill will not accept barrels and drums, other waste specifically banned from landfill disposal by rule or statute, such as appliances, household garbage, construction & demolition debris, lead acid batteries, whole tires, used oil, or aluminum cans. The disposal of any material other than land clearing waste, inert debris, untreated wood, and yard trash is strictly prohibited. Autry Grading, Inc. will notify the Division within 24 hours of attempted disposal of any prohibited waste. Waste accepted by the facility will not be disposed of in water. The burning of solid waste is also strictly prohibited. Leachate shall be contained and managed on -site (.0566(12)). The facility will manage any leachate on the site through the use of best management practices. Within 120 calendar days after completion of any phase of disposal operations, the disposal area shall be covered with a minimum of one foot of suitable soil sloped to allow surface water runoff in a controlled manner. 3.5 Erosion Control The erosion and sedimentation control plan submitted for this site was approved by NCDENR, Division of Land Resources, Land Quality Section by the Arm Pit Mining Permit Modification submitted February 22, 2002 and again August 22, 2012 (See Exhibit 1). Surface water shall be diverted from the working face and shall not be impounded over waste. Ground cover shall be utilized to restrain erosion. All exposed areas shall be covered within 7 calendar days after ceasing land disturbing activity. After the permanent cessation of construction activities, any areas with temporary ground stabilization shall be converted to permanent ground stabilization as soon as practicable but in no case longer than 90 calendar days after the last land disturbing activity. Temporary ground stabilization shall be maintained in a manner to render the surface stable against accelerated erosion until permanent stabilization is achieved. ' �a,nw U E _.S, �F f L T 4.1 Hours of Operation The hours of operation are Monday through Friday. Open hours fluctuate based on the waste stream or other conditions. The LCID will be closed on major holidays. This site does not allow public access. When the facility is open, a representative from Autry Grading shall be present on site to ensure the facility operates in compliance with all operational requirements and to prevent unauthorized disposal of wastes. An entrance sign identifies the facility, permit number, and emergency contact information. After hours emergencies shall be directed to Kenneth Autry at (910) 424-3458. 4.2 Site '&moo Accessa 2 +Y .?..%f Safety Access to the site is controlled through a locked gate entrance, which prevents access after operating hours. A sign is located at the facility entrance indicating the contact name and number for emergencies, address, and permit number. This facility only serves Autry Grading and is limited to deliveries by employees only. No other individual, company, or entity shall be allowed to dispose of waste on the site. An attendant shall be on -site during operational hours to ensure that this rule is followed and to route drivers to the appropriate disposal area. All on -site roads shall be maintained for use in all weather conditions. Autry Grading shall train in-house personnel for operations and maintenance of the facility. The disposal area boundaries are delineated with stationary markers affixed to the ground. The markers are of a height and spacing so that they are distinguishable from the surrounding landscape, and so that the adjacent markers are visible when standing at a marker. (15A NCAC 13B.0201(g)). 4.3 Waste Placement The landfill shall have four phases. Permitted waste shall be off-loaded in the active area, densely placed and compacted. The waste shall be as close as possible to the working face, then pushed to the desired area and compacted with a dozer. The length of the daily working face shall be maintained in order to provide adequate space for vehicles to maneuver. Each phase shall be filled before continuing to the next phase. Required soil cover shall be applied over the waste monthly or when the active area reaches one acre in size, whichever occurs first. Cover soils to operate and close the landfill shall be supplied on site from the permitted Arm Pit Mine. The landfill shall store dedicated equipment to handle the waste. Equipment may include a trackhoe, dozer, front-end loader, and pull behind pan for spreading the daily cover soil. Erosion and sedimentation control measures shall be installed and maintained throughout the operation of the facility. The concentration of explosive gases generated by the facility shall not exceed: (a) Twenty-five percent of the lower explosive limit for the gases in the facility structures. (b) The lower explosive limit for the gases at the property boundary. The Division may require quarterly monitoring of explosive gases if it is necessary to determine compliance with this Item. If the Division requires monitoring, the Division shall provide written notice of the requirement to the owner or operator. Operations Plan — 5-Year Renewal Anderson Engineering & Associates, P.A. LCID Landfill Revised July 2023 Cumberland County, NC Revised December 2023 Page 1 5 On or before August 1 of each year, Autry Grading will report to the Solid Waste Section the amount of waste received at this facility and disposed of in the landfill. Data will be transmitted on forms prescribed by the Section at the website below: https://www.deg.nc.gov/about/divisions/waste- management/solid-waste-section/solid-waste-permitted-facility-information-and-guidance/annual- reportin -Ig ocal-government-and-solid-waste-facility-reporting. The report will include the following: • The reporting period shall be for the previous year beginning July 1 and ending June 30. • The amount of waste received and landfilled in cubic yards, compiled monthly by origin and by specific waste type; and • The completed report shall be forwarded to the Regional Waste Management Specialist. 4,4 Cover Material Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operation has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community. (Rule .0566(4)) Phase 1 is still considered active as it has not reached the final grade. Autry Grading shall continue to add waste to Phase 1 and Phase 2 until they reach an elevation of 176 feet as shown on the Final Grading Plan (Sheet C 104). At that time, they shall maintain intermediate cover until Top Cap has been added. Autry Grading will close out Phase 1 and Phase 2 concurrently. Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first by Section .0566 (4). Compaction is achieved by passing heavy equipment over the soil at least 2 to 3 times. The waste may be covered more frequently if necessary. The disposal area shall be covered with a minimum of one foot of suitable soil cover sloped to allow any surface water to run off in a controlled manner. Further action may be required in order to correct any condition which is or may become injurious to the human health or nuisance to the community. When the landfill will be inactive for at least 120 days, additional cover material shall be placed to provide a minimum of 12 inches of intermediate cover over the waste. Upon completion of each phase of development, vegetative ground cover shall be established within 120 calendar days. Surface water runoff shall be diverted away from the working face without impounding water over waste. Adequate erosion control measures, such as a combination of drainage ditches, diversion berms, vegetative cover, sediment traps, and basins, shall be utilized to prevent silt from leaving the site and prevent on -site erosion. Construction, design, and maintenance of sediment and erosion control features shall be in accordance with applicable sections of the "North Carolina Erosion and Sedimentation Control Planning and Design Manual". Drainage shall be directed to ditches that either exist now or will be constructed and convey the flow to sediment control features. Erosion Control measures were satisfied with the landfill during initial site permitting. 4,5 Litter, ra, Air a a,,4� and D�,.6i t Conl ml Blowing litter shall be controlled by compaction of the waste at the working face. Temporary fences and/or dikes may be constructed to contain windblown material during operations. Landfill personnel shall pick up windblown litter as necessary in and around the active landfill area. Open Operations Plan — 5-Year Renewal Anderson Engineering & Associates, P.A. Dusty road surfaces shall be sprayed with water from a water truck as needed during windy or dry weather. Incoming loads of waste are observed by the site operator for evidence of flames, smoke, or the odor of burning material. If evidence of fire exists, the landfill operator shall evaluate the situation to determine the best way to extinguish the fire. Small fires can be controlled using fire extinguishers or soil located on -site. If necessary, the local fire department shall be called to handle the fire. Fires that occur at the landfill shall be reported verbally to the Division within 24 hours and in writing within 15 days. The standard fire report form is available online and can be filled in and submitted from the following web link: https://edocs.deq.nc.gov/Forms/swfirenotification. If a fire occurs at the waste disposal area, the operator calls Autry Grading, Inc. office to report the size of the fire. When possible, the landfill operator shall utilize the bulldozer on the site to separate the waste/debris from the path of the fire or cover the fire with on -site soil to smother the fire. Once the fire is segregated, the site operator shall evaluate the situation and determine if additional assistance is necessary from the fire department. Fire extinguishers are located on each piece of equipment on -site and equipment operators are trained in their use. Fire extinguishers shall be used for small fires. A stockpile of soil is maintained near the working face for use in extinguishing surface fires. The fire department shall be notified in the case of fires too large for fire extinguishers or soil. In the event the fire requires large volumes of water over an extended period of time, a ladder truck will be dispatched to flood the fire with large amounts of water from an elevated height. Water contained in the sedimentation pond can serve as emergency reservoirs to aid local firefighters in the extinguishing of fires. 4.7 Emergency Contingentcy Plan Immediate action shall be taken upon the discovery of any dangerous or imminent threats to human health or the environment (i.e. on -site accident/injury, release of contaminants to the environment, unauthorized dumping or inclement weather). Unusual or extreme maintenance needs due to natural disasters or vandalism shall be addressed on a case -by -case basis. Routine quarterly inspections shall be conducted throughout the lifetime of the LCID. Operations Plan — 5-Year Renewal Autry Grading, Inc. Revised July 2023 Revised December 2023 Page 1 7 51 Closure Activities Closure of this disposal area shall occur in accordance with the North Carolina Solid Waste Management Rules (15A NCAC 13B .0560) 5.2.1 Cap Design The disposal area shall be covered with a minimum of 12 inches suitable soil cover, sloped to allow any surface water to run off in a controlled manner, within 120 days of the last disposal operation. Vegetative ground cover must be established within 30 working days upon completion of any phases. Proposed final grading contours are provided on Drawing C104. Final contours have been designed with post -settlement surface slopes of at least five percent on top of the cell. The following components are proposed in the cap from bottom to top: a. Compacted Soil Layer — A layer of suitable soil, at least 12 inches thick and compacted in place, shall be placed over the waste. b. Vegetation — If site conditions warrant it, topsoil shall be placed as needed prior to seeding the area. Seeding shall follow the "North Carolina Erosion and Sedimentation Control Planning and Design Manual", and recommendations from local agricultural specialists. Mulch and erosion matting shall be used as needed to control erosion and promote vegetative growth. Areas found to be sparsely covered shall be revegetated. 5.2.2 Cap Settlement and Stability Non -uniform settlement of the closure can be expected over the entire landfill area. The primary mechanism of settlement is waste consolidation due to decomposition of the land filled material. Long-term settlement is typically 5 to 15 percent over 20 to 30 years; however, settlement of about 5 percent can be expected in the first few months following waste placement. A significant amount of waste consolidation will likely have occurred by the time each portion of the landfill is closed. After cap portions are completed, monthly inspections of the final cover shall be conducted to look for areas of the cap that might have experienced displacement (ponding, deep cracks, soil creep, etc.). All problem areas shall be repaired immediately. 5.2.3 Drainage and Erosion A combination of drainage ditches, diversion berms, vegetative cover, sediment traps and basins shall control drainage and erosion. Construction, design, and maintenance of sediment and erosion control features shall be in accordance with applicable sections of the "North Carolina Erosion and Sedimentation Control Planning and Design Manual". Drainage will be directed to perimeter ditches that either exist now or will be constructed. These ditches will receive runoff from the final cap, conveying the flow to sediment control features. An estimate of the quantity of waste to be disposed of is provided in Table 2. The calculation is based on the airspace provided by proposed base and final grades, and assumptions regarding the density of Operations Plan — 5-Year Renewal Anderson Engineering & Associates, P.A. Allowances for the airspace occupied by the cap are included. The estimate was determined using the following steps: 1. Estimate the total airspace in cubic yards using Softdesk Civil/Survey software. The total airspace includes the total volume between the bottom grades (Elevation 140) and the top of the cap system (Elevation 178). 2. Estimate the volume (cubic yards) occupied by the closure cap. 3. Subtract the cap volume from the total airspace volume to estimate the net airspace available for waste disposal. 4. Assume a 9:1 waste to soil ratio. 5. Assumed ratio of incoming waste to the in -place volume of waste and the amount of cover soil in the fill. 6. Annual disposal volume from the past five years is estimated at 16,000 cubic yards. Beginning July 2023, annual disposal volume estimates shall return to normal at 11,000 cubic yards with an increase at a rate of 2% per year. 9 J -„"�3 "f"' ! ff'g G 4 3 R 3 & � a v3 x .� a � �o .i o _ P ' The LCID has a projected remaining operating life of approximately 16 years (See Table 2). However, the landfill is designed to operate in phases so that it can be closed incrementally as final contours are reached in various phases. Prior to beginning closure of any portion of the facility, Autry Grading, Inc. shall notify the Division that a Notice of Intent to close the facility has been initiated and placed in the operating record. Post -closure activities shall be scheduled and implemented at the landfill in accordance with 15A NCAC 13B .0567 and the closure and post -closure plans incorporated into the permit in accordance with Rule .0565(d) of this section. The owner or operator shall notify the Division no less than 90 days prior to the expected closure of each phase. 1) The owner or operator of the site shall begin closure activities no later than 30 days after the final receipt of wastes. Closure activities shall include the following: a) Covering the disposal area with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill; b) Stabilizing the soil cover with vegetative ground cover or other stabilizing material; c) Any closure activities included in the closure and post -closure plan incorporated into the permit. 2) The owner or operator shall complete the closure activities within 120 days after the beginning the closure activities as specified in Subparagraph (1) of this paragraph. 3) Within 30 days of completion of closure of the site, the owner or operator shall submit to the Division a certification verifying that closure has been completed in accordance with this Rule. If required by G.S. 89C, the certification shall be completed by a licensed professional engineer. 4) When a site has been closed in accordance with this Rule, the permit is terminated. Any future solid waste management or disposal at the site shall require a new permit. Operations Plan — 5-Year Renewal Anderson Engineering & Associates, P.A. Autry Grading, Inc. LCID Landfill Revised July 2023 Cumberland County, NC Revised December 2023 Page 1 9 The owner or operator shall complete the following closure activities to close the site: 1) Ensure that all LCID materials have been properly disposed of or removed from the site. 2) Provide at least one foot of soil cover at the disposal site, and provide positive drainage. 3) Ensure that the soil cover is stabilized with vegetative ground cover according to the approved vegetation plan. At least one sign shall remain posted at the entrance to the facility reporting of the facility closing. A notice shall remain posted at the entrance prohibiting the further acceptance of waste materials. The site shall be secured through the use of gates with locks, fencing, and/or natural barriers. Security will be inspected and maintained throughout the post -closure period. If necessary, the site will be baited for rodent and vector control before the final closure has begun. 1) Following closure of the site, the owner or operator shall conduct post -closure care in accordance with the closure and post closure care plan incorporated into the permit and the following requirements: a) Maintenance of the cap system, including making repairs to the cover to correct the effects of settlement, subsidence, erosion, or other events, and preventing surface water run-on and run-off from eroding or otherwise damaging the cap system. b) Maintenance of the vegetative cover of the cap, and ensuring that trees and other woody vegetation do not become established on the cap; c) Maintenance of vehicle and fire -fighting lanes to allow access to the entire waste boundary of the site; d) Groundwater, surface water, and explosive gas monitoring in accordance with the closure and post -closure care plan, if required by the Division. e) Maintenance of the operating record by the owner or operator. The operating record shall be made available to the Division for inspection upon request during post -closure care period; and f) Any additional actions that the Division may request in writing if the Division determines that the actions are necessary to correct any condition that may be injurious to the public health or a nuisance to the community. LITTER, BUILDING MATERIAL AND LAND CLEARING WASTE 1. Never bury or burn waste. Place litter and debris in approved waste containers. 2. Provide a sufficient number and size of waste containers (e.g dumpster, trash receptacle) on site to contain construction and domestic wastes. 3. Locate waste containers at least 50 feet away from storm drain inlets and surface waters unless no other alternatives are reasonably available. 4. Locate waste containers on areas that do not receive substantial amounts of runoff from upland areas and does not drain directly to a storm drain, stream or wetland. 5. Cover waste containers at the end of each workday and before storm events or provide secondary containment. Repair or replace damaged waste containers. 6. Anchor all lightweight items in waste containers during times of high winds. 7. Empty waste containers as needed to prevent overflow. Clean up immediately if containers overflow. 8. Dispose waste off -site at an approved disposal facility. 9. On business days, clean up and dispose of waste in designated waste containers. PAINT AND OTHER LIQUID WASTE 1. Do not dump paint and other liquid waste into storm drains, streams or wetlands. 2. Locate paint washouts at least 50 feet away from storm drain inlets and surface waters unless no other alternatives are reasonably available. 3. Contain liquid wastes in a controlled area. 4. Containment must be labeled, sized and placed appropriately for the needs of site. 5. Prevent the discharge of soaps, solvents, detergents and other liquid wastes from construction sites. PORTABLE TOILETS 1. Install portable toilets on level ground, at least 50 feet away from storm drains, streams or wetlands unless there is no alternative reasonably available. If 50 foot offset is not attainable, provide relocation of portable toilet behind silt fence or place on a gravel pad and surround with sand bags. 2. Provide staking or anchoring of portable toilets during periods of high winds or in high foot traffic areas. 3. Monitor portable toilets for leaking and properly dispose of any leaked material. Utilize a licensed sanitary waste hauler to remove leaking portable toilets and replace with properly operating unit. EARTHEN STOCKPILE MANAGEMENT 1. Show stockpile locations on plans. Do not store herbicides, pesticides and rodenticides in areas where flooding is possible or where they may spill or leak into wells, stormwater drains, ground water or surface water. If a spill occurs, clean area immediately. 4. EFFECTIVE DATE: 11/12/2020 PART II, SECTION G, ITEM (4) DRAW DOWN OF SEDIMENT BASINS FOR MAINTENANCE OR CLOSE OUT Sediment basins and traps that receive runoff from drainage areas of one acre or more shall use outlet structures that withdraw water from the surface when these devices need to be drawn down for maintenance or close out unless this is infeasible. The circumstances in which it is not feasible to withdraw water from the surface shall be rare (for example, times with extended cold weather). Non -surface withdrawals from sediment basins shall be allowed only when all of the following criteria have been met: (a) The E&SC plan authority has been provided with documentation of the non -surface withdrawal and the specific time periods or conditions in which it will occur. The non -surface withdrawal shall not commence until the E&SC plan authority has approved these items, (b) The non -surface withdrawal has been reported as an anticipated bypass in accordance with Part III, Section C, Item (2)(c) and (d) of this permit, (c) Dewatering discharges are treated with controls to minimize discharges of pollutants from stormwater that is removed from the sediment basin. Examples of appropriate controls include properly sited; designed and maintained dewatering tanks, weir tanks, and filtration systems, (d) Vegetated, upland areas of the sites or a properly designed stone pad is used to the extent feasible at the outlet of the dewatering treatment devices described in Item (c) above, (e) Velocity dissipation devices such as check dams, sediment traps, and riprap are provided at the discharge points of all dewatering devices, and (f) Sediment removed from the dewatering treatment devices described in Item (c) above is disposed of in a manner that does not cause deposition of sediment into waters of the United States. When adverse weather or site conditions would cause the safety of the inspection personnel to be in jeopardy, the inspection may be delayed until the next business day on which it is safe to perform the inspection. In addition, when a storm event of equal to or greater than 1.0 inch occurs outside of normal business hours, the self -inspection shall be performed upon the commencement of the next business day. Any time when inspections were delayed shall be noted in the Inspection Record. (b) Records of inspections made during the previous twelve months. The permittee shall record the required observations on the Inspection Record Form provided by the Division or a similar inspection form that includes all the required elements. Use of electronically -available records in lieu of the required paper copies will be allowed if shown to provide equal access and utility as the hard -copy records. 3. Documentation to be Retained for Three Years All data used to complete the e-NOI and all inspection records shall be maintained for a period of three years after project completion and made available upon request. [40 CFR 122.41] rNR f m SELF -INSPECTION, RECORDKEEPING AND REPORTING SECTION C: REPORTING 1. Occurrences that Must be Reported Permittees shall report the following occurrences: (a) Visible sediment deposition in a stream or wetland. (b) Oil spills if: • They are 25 gallons or more, • They are less than 25 gallons but cannot be cleaned up within 24 hours, • They cause sheen on surface waters (regardless of volume), or • They are within 100 feet of surface waters (regardless of volume). (c) Releases of hazardous substances in excess of reportable quantities under Section 311 of the Clean Water Act (Ref: 40 CFR 110.3 and 40 CFR 117.3) or Section 102 of CERCLA (Ref: 40 CFR 302.4) or G.S. 143-215.85. (d) Anticipated bypasses and unanticipated bypasses. (e) Noncompliance with the conditions of this permit that may endanger health or the environment. 2. Reporting Timeframes and Other Requirements After a permittee becomes aware of an occurrence that must be reported, he shall contact the appropriate Division regional office within the timeframes and in accordance with the other requirements listed below. Occurrences outside normal business hours may also be reported to the Department's Environmental Emergency Center personnel at (800) 858-0368.
