Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The purpose of this visit was to conduct a follow up of the Yard Waste Notification (YWN). A Debris site is also onsite and is not activated at this time. The gate was open and unlocked upon arrival during lunchtime. Be mindful of closing/locking gates to prevent entry and unapproved wastes left onsite by unauthorized people from the public. The site is used for temporary storage of YW, soil, asphalt, and rock. The YW is staged here until there is enough for a full load to Moore County permitted site, per 2023 renewal. In the 2022 renewal, a map was provided with renewal outlining onsite operations and should continue to be used unless onsite operations change, in which, a new map should be provided for the Sections record. Looking towards the entrance of YWN. Recyclable materials on side. 2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year. EOW markers are still in place as previously installed. Good job. A dumpster is onsite for unapproved waste. Soil, rock and asphalt were stored onsite. Some YW was staged onsite waiting to be hauled to Moore County. There were a couple of unapproved wastes onsite comingled with the YW, pallets and a tire. Please be sure to remove it to an appropriate disposal site for this waste. Be sure and not comingle unapproved waste to Moore Counties permitted site. YW area. Mr. Powell contacted Mr. Alders in following days and discussed what this was found onsite. Mr. Alders explained their “Vac truck” was used to clean out a ditch from a repair project and it was soil drying from that cleanup. This comingling of soil inside of a wastewater vacuum truck can possibly contaminate the soil and be a public health concern. Mr. Powell explained if this is same vehicle used for wastewater applications and cleaning out lift stations etc., then all of this material that was contacted with that truck should be taken to a lined MSW, through transfer station if allowed, or to a permitted wastewater facility approved for drying solids such as a drying bed. Also, be mindful, if doing this in the future a lined MSW cannot take liquid waste and the town may need to take this waste if in liquid form to a site that is approved and can solidify, then contain it and then dispose of both the liquid and solid aspects of this waste. Be sure and follow the map that was submitted regarding placement of YW, recyclable materials and any future YW debris, should the site be activated. TDDS must be activated by calling the Section before accepting any disaster debris. 6. Corrective measures are necessary as a result of the inspection findings and shall be completed within 30 days’ receipt of this report. Failure to ensure corrective measures are complete may result in further compliance actions.
