Surface water shall be diverted from the operational area. 2. 15A NCAC 13B .0542 (l)(2) - Drainage control and water protection requirements. Surface water shall not be impounded over or in waste. Section Staff inspected the CDLF on January 4, 2024, to inspect Robeson County landfills for a follow up on previously identified violations and corrective actions. Upon inspection of the CDLF landfill, a large area was observed left open at a lower elevation, between the inactive cells and active cell, causing water to impound over waste. Soil cover should be compacted, graded and sloped in a manner to restrain erosion while allowing stormwater to divert from the landfill surface. Entrance to new cell from a distance. The purpose of this visit was to do a follow-up of the Robeson County Landfills. Mr. Powell met with Mr. Walters once onsite and before riding around the facility. The CDLF has had soil cover added onto the western side slope of the older phases, good job. Please maintain proper intermediate cover across the older cells in which no waste shall be placed for three months or more, but final termination of disposal operations has not occurred. Side slopes around the CDLF seemed to be well mowed, mostly vegetated and minimal erosion. The top of the older cells was not visited during this inspection. Mr. Walters and Mr. Powell discussed the findings while onsite. Mr. Walters explained the landfill had some new staff to haul soil and they have been addressing cover but still needs work. Possible solutions were discussed, and Counties continued effort to find contractors further away from Robeson County. 2. CDLF working face on the west of the active cell. Much soil cover and ADC mulch/soil has also been added across the active cell with current working face. Soil was also staged near the EOW along the western edge of the active cell. The working face was smaller this visit and was being compacted and covered slowly during visit. Cover logs were not reviewed this visit, but cover is needed much more frequently at working face. Be sure are kept and maintained in accordance with the rule. Working face The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Older cell side slopes have been mowed previously, mostly vegetated, minimal erosion and proper sloping. SW corner of CDLF, with new cell and older cell in view. Southern side slope. Pallet area didn’t have any unapproved waste visible during inspection. Good job. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 8 of 8 6. 15A NCAC 13B .0534 (b)(2)(I) Proper Operation and Maintenance. The permittee shall at all times operate and maintain all facilities and systems of treatment and control and related appurtenances which are installed or used by the permittee in compliance with the conditions of the permit. Proper operation and maintenance include effective performance, adequate funding, adequate operator staffing and training, and adequate laboratory and process controls, including appropriate quality assurance procedures, in accordance with the conditions of the permit. This provision requires the operation of back-up or auxiliary facilities or similar systems only when necessary to achieve compliance with the conditions of the permit. 7. Corrective measures are necessary as a result of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff within about 60 days’ receipt of this inspection report. Failure to meet the conditions for compliance may result in further Compliance Actions.
