November 2005 and June 2006 Limited Authorization to Place Recycling Operations on Portions of Certified Closed LCID. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 9 ADDITIONAL COMMENTS 1. The purpose of the visit was to inspect the CDLF for closure, view the closed MSW and the recycling area over the closed LCID. Section staff Andrew Hammonds and David Powell met with Fort Liberty Staff, Shawn Hardy, Jim Duncan, Dan Messier and Bryan Locklear. The site is on a U.S. military base, behind locked gate and fence with all- weather roads. A letter, with corresponding map and operations plan, dated November 9, 2005, giving limited authorization to Fort Bragg for recycling operations on portions of the certified closed LCID 26G. The request from Fort Bragg, dated October 31, 2005, included stock piling clean concrete to be crushed for reuse, stock piling and grinding pallets and clean wood for mulch, stock piling and grinding yard waste and tree waste for mulch, stock piling soil for reuse, and stock piling Class “A” Bio-solids for mixing with soils and mulch for reuse. A follow up letter was dated June 8, 2006, from the Section for acceptance of final cover and extending the recycling operation approval. A copy of this information along with other documentation was sent to new operations staff at Fort Bragg, now Fort Liberty, again with this inspection report. 2. Entrance to LCID, CDLF and Transfer Station facilities is the same and they are closed except due to final cover, cap operations at the CDLF and recycling operations approved on top of closed LCID. Entrance inside Fort Liberty to LCID, CDLF and Transfer Station. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The upfront area is where the scrap metal/white goods sorting and staging is being done. Behind that, is where concrete is being crushed on the right, and then pallet/YW chipping, grinding, and then composting in rear. Current operations mostly align with an approved map, just be sure and continue to go by what’s approved. There was a large volume of waste collected in the yard waste area and in need of processing/removal. There was a good amount of ground material in windrows as well. Be sure to keep enough separation in case of fires and access for firefighting should the need arise. Very minimal unapproved wastes were observed at all. There was some erosion on the backside that needed addressing. Site has been accepting Yard Trash as well as yard waste, therefore, all waste needs to be composted meeting 15A NCAC 13B .1406 rules before waste can be removed, same as a small type 1 facility. Time and temperature records need to be kept along with a map so that when DEQ SW Inspector returns he can verify proper composting of each pile. Suggest keeping all relevant documents, records and logs for all sites at this location and/or close by together and bring them next inspection for review. Some records were reviewed recently during discussions for this facility before inspection in recent weeks. 15A NCAC 13B .1406 (11) - Compost process at Type 1 and Type 2 facilities shall be maintained at or above 55 degrees Celsius (131 degrees F) for three days and aerated to maintain elevated temperatures. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 8 of 9 5. Concrete recycling storage has been significantly decreased since last visit. Good Job. Reminder of the “75% rule 130A-309.05. Regulated wastes; certain exclusions. Basically it means 75 % of the material, from the dated collected must be gone by end of one year. Please read entire rule for specifics and relevant requirements for the operations at this site. Concrete crushing and sorting. 6. The perimeter area of the closed landfill should be mowed frequently to allow for proper inspection of slopes and MWs. Has been mowed since last visit, good job. 7. Please continue with the momentum created so far at the recycling center and the CDLF closure. A copy of the limited operations atop closed LCID agreement, approved map, operations plan and 15A NCAC 13B .1400 rules will be sent with this inspection report for review. Any alterations in operations should be submitted to Section Permitting before those operations change.
