PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: A. 15A NCAC 13B .1402 (e)(1), "Type 1 facilities may receive yard and garden waste, silvicultural waste, and untreated and unpainted wood waste." During the inspection, unacceptable wastes such as insulation, plastic piping, plastic bags, painted and treated wood were identified within the waste stream along one of the access roads. Remove and dispose of unacceptable waste as soon as it is observed. B. 15A NCAC 13B .1402 (e)(6)(A), "Small Type 1 facilities shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards material onsite at any given time, including finished product." The area containing waste was estimated to be approximately 14 acres in size. C. 15A NCAC 13B .0103 (e), "No person shall dispose or cause the disposal of solid waste in or on waters in a manner that results in solid waste's entering waters or being deposited upon lands of the State." During this inspection, yard trash and land clearing waste has been deposited outside of the 2-acre notification and pushed into a pond located near the center of the western half of the property. Concrete had also been placed along the northern edge of the larger pond near the center of the northern site boundary. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. In addition to yard wastes generated by Spain Farms, the site accepts yard waste from the City of Smithfield. 2. The access road to the facility is being managed properly at this time. 3. 15A NCAC 13B .1404 (c)(1) "a site shall not allow unauthorized public access." It is recommended that a locking gate be installed to prevent unauthorized access to the site when an attendant is not present. 4. 15A NCAC 13B .1406 (9)(a) "Signs providing information on wastes that may be received, dumping procedures, the hours during which the site is open for public use, and the permit number shall be posted at the site entrance." and 15A NCAC 13B .1406 (9)(c) "Signs shall be posted stating that no hazardous waste, asbestos containing wastes, or medical waste may be received at this site." Please post the appropriate signs at the entrance to the site. 5. Based on the most recent yard waste notification, the waste is ground, composted, then spread onto agricultural fields as a soil amendment. Based on the amount of waste observed on site, it appears that the yard waste has not been ground or utilized as identified since the last inspection. Please provide the approved soil nutrient management plan for sites where the mulch is utilized and an amendment. 6. CEASE accepting waste at the facility until the facility is in compliance. This facility is not a landfill for disposal of waste. Remove any buried waste and waste dumped in water. 7. A permit is required to increase the size, quantity, and type of waste. 8. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed.
