Renewal YWN submitted on May 21, 2021. Per 15A NCAC 13B .1402 (g)(1), the owner or operator of any Type 1 Solid Waste (yard waste) facility which occupies less than two acres of land and be limited to no more than 6,000 cubic yards material onsite at any one time, including finished product, shall submit a renewal form to the Section by June 1st of each year. The Yard Waste Notification MUST be submitted immediately. CEASE accepting waste at this facility. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTED VIOLATIONS A. 15A NCAC 13B .1406 (6), "A site shall only accept those solid wastes that it is permitted to receive." UNRESOLVED: At the time of this inspection, the gate was locked. The Section could not access the facility to determine if the previously identified unacceptable wastes have been removed. The Section will contact facility staff to schedule the next inspection. OBSERVED VIOLATIONS: A. 15A NCAC 13B .1401(a), "No person shall construct, operate, expand, or modify a facility that produces compost from solid waste or solid waste co -composted with other waste unless it has a currently valid permit issued by the Division for a solid waste compost facility, except as provided in Rule .1402(f) and (g) of this Section." and Page 1 of 3 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA OepaNnent W Enviranmmbl Welily Solid Waste Section 15A NCAC 13B .1402 (g)(1)(A), "notification to the Division prior to operation and on an annual basis." A notification has not been submitted to the Division since May 2021. The facility is currently operating without a proper notification. A notification MUST be submitted to the Division immediately. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility accepts waste from Town of Woodland Groundskeeping activities. No wastes are accepted from the general public. The waste is ground on site then used around the bases of flowers, shrubs, and trees around Woodland. 2. The access road to the facility is being properly managed at this time. 3. Access to the site is controlled by a locking gate, which was locked during thus inspection. Signage is posted at the gate with emergency contact information. 4. A digital photograph of the southern portion of the yard waste area was taken from the gate during the inspection. 5. Corrective actions are required as a result of this inspection report and must be completed within 30 days' receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed. Please contact me if you have any questions.
