FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 PURPOSE OF SITE VISIT: Comprehensive Inspection – Pre-Operation STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: N/A ADDITIONAL COMMENTS 1. David Powell with the Solid Waste Section (Section) met with Marcus Alexander, with American Tire Distributors (ATD), for an inspection. The facility has not begun to accept scrap tires so this visit will be considered a pre-Operation inspection and technical assistance. Mr. Powell contacted ATD representatives to share contact information and to schedule an inspection with onsite staff. Site is a warehouse building which intends to accept scrap tires, process them at the warehouse, and use large 18-wheeler container trailers for storing and hauling them to Central Carolina Tire Processing, permit 4308-TIRETP, in Cameron NC. Mr. Alexander estimated Mid-January 2024 the facility should begin accepting tires. Mr. Alexander also explained each driver had an identification certificate for Scrap Tire Hauling, see photo below. During inspection, Mr. Powell reviewed the permit with Mr. Alexander. Mr. Powell emailed General Manager William Smith and Marcus Alexander copies of the permit, application and cover letter for their records after the inspection. A follow-up to view the operation, once it begins, and the records should be conducted in early 2024. ATD staff should compile all records emailed, along with this inspection report and scrap tire documents as they are collected or created and keep a file for review during future inspections. Please review the permit to see what is required to have it onsite for review by Section Staff in future. Inspections are not always scheduled but Mr. Powell wanted to be sure the facility was open and to introduce himself to onsite staff. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The site is inside the warehouse and inside onsite trailers that will be docked to loading bays. Since there are no fences onsite the facility must control access to the site to meet the rules. See rule reference below and adjust onsite operations accordingly if necessary. Permit Attachment 3, Part 1.
