Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 1 of 2 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section ADDITIONAL COMMENTS 2301-MSWLF-1990 Cleveland County Landfill (West MSWLF) Closed 1. The county operated an unlined sanitary landfill designated as "the West (Landfill) Site which has not received municipal waste since December 1997. 2. On January 2, 1998, the Solid Waste Section approved the modification to the landfill permit to allow the construction and operation of a Construction & Demolition Landfill Unit, Phases 1, 2 and 5. 2301-MSWLF-1998 Cleveland County Landfill (East MSWLF) Closed 3. This MSW landfill was constructed as a new lined (Subtitle D) landfill designated as "the East (Landfill) Site," which began operations in July 1998. 4. On December 6, 2007, the county was issued a permit to construct the initial phases of a new Subtitle D Landfill designated as "the Self-McNeilly (Landfill) Site." Self-McNeilly began receiving waste in September 2009. The disposal of municipal solid waste at the East Site was discontinued at the end of 2009. Records Review 5. Reviewed semi-annual groundwater monitoring reports east and west sites (May 2020, October 2020, July 2021, October 2021, June 2022, August 2022, February 2023, and August 2023). 6. Reviewed quarterly monitoring reports east and west sites (lst, 2nd, 3rd, 4th Quarter 2020, 1st, 3rd, 4t' Quarter 2021, 1st, 2nd,3rd, 4' Quarter 2022 and lst, 2nd, 3rd and 4th 2023). The 2nd quarter 2021 monitoring report was not submitted to the Section and was noted as an observed violation on the June 2, 2022, inspection report and resolved on the May 19, 2023, inspection report. 7. An inspection of ground water and landfill gas monitoring wells was conducted. All wells were properly tagged and secured with padlocks. 8. Edge of waste markers were in place and visible along the perimeter of the landfill. 9. The landfills had good vegetative cover and no erosion issues. 10. There were no trees or woody vegetation on the cap. 11. No ponding of water on the landfills was observed.
