Teresa Bradford, DEQ – Solid Waste Section Deb Aja, DEQ – Solid Waste Section STATUS OF PERMIT: A Permit Amendment to the Permit to Construct Phase 4 and the Permit to Operate Phases 1-3 was issued to BFI Waste Systems of North America, LLC, a wholly owned subsidiary of Republic Services, Inc. on July 20, 2022. In accordance with N.C.G.S. 130A-294(a2), the Permit is for the life-of-site of the facility which is defined as the period from the initial receipt of solid waste at the facility until the facility reaches its final permitted elevations, which period shall not exceed 60 years. Permit number 1304-MSWLF-1992 was approved to begin waste receipt operations on March 6, 1992, therefore the Permit shall expire on March 6, 2052. On December 4, 2023, the facility received approval from the Solid Waste Section to operate Phase 4 (South), Stage 1. PURPOSE OF SITE VISIT: Follow-up Inspection/Pre-Operational Inspection STATUS OF PAST NOTED VIOLATIONS: Information and photographs contained directly below is representative of inspections on 10/24/23 & 12/4/23 and show progress being made towards compliance with past noted violations. A. 15A North Carolina Administrative Code 13B .1626(2)(b) for failing to adequately cover all disposed waste with six inches of earthen material. Corrective Actions in Progress FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 10 • Upper deck: As of the December 4 inspection, it appeared that the upper deck had adequate soil cover except in the area where a stockpile of waste mixed with soil from back blading activities was observed at the edge of the upper deck. Facility staff stated that the stockpile would be removed and delivered to the working face. • Areas surrounding working face: As of the December 4 inspection, it appeared that areas surrounding the working face had adequate soil cover. • Cell 2J sliver fill: As of the December 4 inspection, the facility was completing a sliver fill by adding waste to the western side of Cell 2J. The facility staff stated that waste in this area would be covered by the end of the day. • Haul road and clean out area: As of the December 4 inspection, some waste was observed along the haul road. Also, a stockpile of waste mixed soil and bagged waste was observed in an area off of the haul road, close to Phase 4. Facility staff stated that this waste would be removed and delivered to the working face. • Landfill side slopes: As of the December 4 inspection, it appeared that landfill side slopes had adequate soil cover. During the December 4 inspection an area on the eastern side slopes of Cells 2I and 2J, that had been previously covered and seeded had been reopened for infrastructure construction. Facility staff stated that the areas under construction are covered at the end of the operating day. Facility staff provided a photograph via email on December 5 showing the area covered. Bradford) C. 15A North Carolina Administrative Code 13B .1626(1)(g) for allowing waste to be displaced and leave the base liner system during rain events due to failure to maintain soil cover. Durin the December 4 inspection, some areas on the southern side of the landfill were observed to have been covered and or repaired. Due to construction along the access road, the entire perimeter of the landfill could not be inspected. Therefore, a follow-up inspection will be conducted. Corrective Actions in Progress FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 7 of 10 D. 15A North Carolina Administrative Code 13B .1626(8)(d) for failing to contain leachate within the lined disposal cell or leachate collection and storage system. The leachate in the perimeter ditch on the eastern side slope of Cell 2J that was observed during the June 29 and July 25 inspections had been removed and the ditch repaired. This violation will remain open until any sampling requirements have been met and to ensure that no further action is required for all areas of leachate releases. Corrective Actions in Progress E. 15A North Carolina Administrative Code 13B .1626(8)(d) for failing to contain leachate within the lined disposal cell or leachate collection and storage system. During the October 24 inspection, the leachate outbreak noted during the October 6 inspection was observed to have been repaired. This violation will remain open until any sampling requirements have been met and to ensure that no further action is required for all areas of leachate releases. The facility is permitted to receive solid waste generated from within the City of Concord, Cabarrus County, the State of North Carolina, and the following counties in the State of South Carolina: Cherokee, York, Lancaster, Chesterfield and Chester. 2. Proper signage was observed at the entrance of the facility. 3. A gate is provided at the entrance of the facility to prevent unauthorized access. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. On December 4, 2023, the facility received approval from the Solid Waste Section to operate Phase 4(South), Stage 1. During the December 4 inspection, Phase 4(South), Stage 1 was observed and appeared to have construction completed. Edge of waste markers were not present during the inspection. Bradford) Operations Inspection of the MSWLF: 5. This follow-up inspection was conducted to determine if compliance actions were completed for the violations noted in the previous inspections on December 7, 2022, January 27, 2023, April 19, 2023, June 29, 2023, July 25, 2023, October 6, 2023. 6. During the October 24 and December 4 inspections, it appeared that the eastern and southern landfill side slopes from Cell 2I through 2M had adequate soil cover and was seeded. Also, during the October 24 and December 4 inspections, the upper deck had been bladed so that the ruts were removed throughout most of the area and it appeared that adequate soil cover had been applied to a majority of the upper deck. Ensure that when the upper deck or haul road is back bladed, that the waste is returned to the working face or covered. 7. During the December 4 inspection, an area on the eastern side slopes of Cells 2I and 2J that had been previously covered and seeded had been reopened to allow for the installation of a leachate collection system to include a drain at the toe of the slope in an effort to prevent or minimize the leachate outbreaks in this area. According to facility staff, the contractor is responsible for covering any exposed waste in the area at the end of each operational day. 8. During the December 4 inspection, a sliver fill was being completed on the western side of Cell 2J. Facility staff stated that the waste placed in this area would be covered by the end of the operating day. 9. Windblown waste was observed during the December 4 inspection. Section staff noted that it was a windy day and workers were observed collecting litter during the inspection. Ensure that all windblown waste is collected and returned to the working face or containerized by the end of each operating day. 10. During the December 4 inspection, erosion rills were observed in the newly seeded area on the eastern side of Cell 2J below the edge of waste markers. Facility stated that there was heavy rainfall in the days preceding the Monday, December 4 inspection. Take measures to ensure that erosion rills are repaired. Also, take measures to ensure that the perimeter ditch in this aera is repaired. The leachate outbreak observed on the eastern side of Cell 2K during the October 6 inspection was observed to have been repaired on October 24 inspection. No new leachate outbreaks leaving the base liner system were observed during the October 24 or December 4 inspections. Facility staff stated that the leachate sump for Cell 2J and 2K is still being pumped routinely to help control leachate outbreaks. 13. The odor neutralizing system along the southeast corner of Cell 2M was operational during the October 24 inspection. The system was not operating during the December 4 inspection. According to facility staff, the product used in the system was to be received later in the week. 14. Edge of waste markers were being maintained. 15. Access roads were well maintained. 16. It is recommended that the facility be cognizant of the potential odor generation during maintenance and/or cover activities later in the day and how it may be impacted by atmospheric changes. It is further recommended that the facility consider alternative methods such as beginning closure activities earlier in the working day to ensure proper cover is being applied to minimize odors. Many people in the surrounding community are returning home from work, etc., so the longer into the evening the facility is operating increases the potential for nuisance conditions to exist and for complaints to be generated. 17. As noted above, substantial progress has been made to remedy the previously noted violations. All applicable conditions for compliance and deadlines noted in the September 20, 2023 Order remain in effect. Please continue to work on any outstanding matters and keep the Section updated as progress is made.
