Permit to Operate will expire April 17, 2025. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTICE OF VIOLATIONS: Date of Last Inspection: June 2, 2023 3505-MWP A. 15A NCAC 13B .0101 (28), "'Inert debris waste' means inert debris that consists solely of asphalt, cured concrete, brick, concrete block, gravel, and rock. Inert debris waste shall not contain chemical adhesives or sealants, or lead -based paint." CORRECTIVE ACTIONS IN PROGRESS: The countertop material is still being uncovered in the inert debris stockpile. Mr. Kiefer stated that the countertop material had been removed from the roadway from the scale house to the tipping floor. Mr. Kiefer also stated that the countertop material is disposed of at the Brownfield CDLF. The countertop materials have been treated with sealants and have adhesives on the back and do not meet the definition of an inert debris as defined in 15A NCAC 13B .0101 (28). Continue to remove the countertop material from the inert debris stockpile and roadways. NOTICE OF VIOLATIONS: A. 15A NCAC 13B .0201 (c), "No solid waste management facility shall be established, operated, maintained, constructed, expanded, or modified without a valid permit issued by the Division for the specified type of activity. It is the responsibility of every owner or operator of a proposed solid waste management facility to apply for a permit for the facility." During this inspection, the land clearing waste within the T&P area had been covered by soil. Mr. Kiefer stated that the land clearing waste was covered with soil to ensure that the land clearing waste would not catch fire during the winter. Mr. Kiefer also stated that the land clearing waste would be uncovered, screened, and ground in the Spring. Upon review of the permit and operations plan, the T&P area has not received the proper approval for disposal. The Facility must excavate and properly dispose of the land clearing waste or excavate. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility is fenced and is secured by a locking gate when it is not open for operation. 2. Correct signage is at the entrance of the facility listing the facility name, permit number, emergency contact information as well as materials accepted at the facility. 3. The facility accepts waste Monday through Friday from 0700 to 1800 and Saturday from 0800 to 1500. 4. The facility is in the process of installing an access roadway around the LCID; however, the roadway was constructed with the comingled ground countertop and concrete material. The facility is in the process of removing the countertop material from the roadway. Continue to establish and maintain the access roads around all areas for fire and emergency response vehicles. 6. A water truck is located at the property and is used to control dust emissions at the facility. 7. No areas of standing water were observed in the MAT area. Continue to ensure that the area is graded so that water is shed from the operating area. 8. Minimal windblown waste was observed during this inspection. Continue to ensure that windblown is removed prior to the end of the day. 9. The LCID has been covered with soil. Soil had been staged at the top of the LCID so that the slopes could be reworked to meet the three horizontal to one vertical ratio. 10. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility. 11.
