June 9, 1997. This plan is reviewed annually and this letter should be considered as a
status report for the preceding 12 months

Re: Closure Plan, Ecusta Industrial Landfill, Permit Number 88-05 Transylvania County
Dear Mr. Cody:
The purpose of this letter is to inform the owner/operator that the Solid Waste
Section(Section) has approved the Closure Plan dated February, 2000, for the referenced landfill.
Upon final termination of disposal activities on or before January 1, 2003, the landfill shall be
covered with at least two(2) feet of suitable compacted cover in accordance with Rule
.0505(3)(c). In addition, the final cover shall be sloped such that surface water runoff occurs in a
controlled manner, and surface water shall not be impounded over waste.
The Section will consider approval, as a demonstration project, of the placement of
structural fill and the enhanced capping system, limited to the Cell 1 development area, as
proposed in the Closure Plan. Approval of the placement of the enhanced capping system for the
remainder of the landfill would be conditional upon the Section's review of the documentation
submitted for the initial phase of capping. The Section may require revisions to the enhanced
capping plan for the remainder of the landfill based upon the performance of the initial phase. If
Ecusta intends to propose the enhanced capping system at a later date, the plan should be
submitted to the Section for approval at least 180 days prior to anticipated commencement date.
The so-called "industrial waste rule"-Rule .0503(2)(d)(ii) of the solid waste management
rules codified at l 5A NCAC l 3B, required that operators of industrial waste landfills operating
on or after January 1, 1998, submit to the Division of Waste Management, Solid Waste
Section(Section) a design that will ensure that the ground water standards established under 15A
NCAC 2L will not be exceeded in the uppermost aquifer at the compliance boundary established
by the Division in accordance with l 5A NCAC 2L.
Rule .0503(2)( d)(ii) of the solid waste management rules codified at l 5A NCAC 13B
required that operators of industrial waste landfills operating on or after January 1,1998, submit
to the Division a design that will ensure that the ground water standards established under 15A
NCAC 2L will not be exceeded in the uppermost aquifer at the compliance boundary established
by the Division in accordance with 15A NCAC 2L.

As stated in the letter dated June 7, 1999, the Section has determined that the iiifo.rrnation
submitted does not meet the requirements of this Rule. Specifically, the submitted ground water
monitoring information does not demonstrate compliance with the ground water standards in the
upper most aquifer at the compliance boundary; the modeling information submitted does not
provide adequate hydro geologic characterization of the site to demonstrate future compliance
with ground water standards in the upper most aquifer at the compliance boundary; and the
information provided concerning previously disposed wastes does not provide accurate physical
and chemical characteristics of the leachate.
It is important to note that this determination means only that the owner/operator has not
demonstrated compliance with the industrial waste rule. No determination has been made
regarding current compliance with the l 5A NCAC 2L regulations. As with all sanitary landfills,
any necessary future detection and assessment ground water monitoring and possible corrective
action will be based on ongoing water quality monitoring results.
