FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section OBSERVED VIOLATIONS: A. RESOLVED: 15A NCAC 13B .0105(c) states: "Vehicles or containers used for the collection of solid waste, and transportation by whatever means, including highway, rail, and navigable waterway, shall be constructed, operated, and maintained to be leak resistant in order to prevent the creation of a nuisance to public health from the escape of solid, semi -solid, or liquid waste. In order to meet the requirement to be leak resistant, the owner or operator of the vehicle or container shall adhere to the following standards: (1) All surfaces that come in contact with waste shall be smooth and non -absorbent. (2) All drain holes and valves shall be closed, plugged, or sealed. (3) The vehicle or container shall be equipped with seals, gaskets, or other devices pursuant to manufacturer specifications in order to prevent the escape of liquids. Such seals, gaskets, and other devices shall be maintained and replaced pursuant to manufacturer specifications. (4) The vehicle or container body, waste holding area, and hopper, if so equipped, shall be free of holes, cracks, rusting, corrosion, or other evidence of damage or weakness that may allow the escape of solid, semi -solid, or liquid waste. (5) The waste holding area, including the hopper and around the packer blade, if so equipped, shall be clear of debris to prevent vectors or the accumulation of litter. (6) The vehicle or container shall be loaded, transported, operated, and maintained to prevent the escape of solid, semi -solid, or liquid waste to the environment. (7) The vehicle or container shall be serviced, repaired, and cleaned to preserve the integrity of the door seal, to prevent the accumulation of mechanical fluids, dirt, leachate, and waste particulates on the vehicle's exterior, and to prevent contamination of the environment by fluids. " During the inspection leachate was observed leaking from the rear of the compactor door seal area. The compactor was pulled from service on September 25, 2023, to inspect the seals and make necessary repairs. The maintenance of the compactor consisted of cleaning out the RAM, behind the RAM, cleaning the door seal and inspection for any damage to seals. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The required signage is posted at the entrance of the facility. 2. The facility is secured by an automatic gate at the entrance to prevent unauthorized access. 3. The facility is open from 7 am to 4 pm Monday through Friday. 4. The facility is permitted for the treatment of medical waste with steam sterilization, as well as the storage and processing of treated and untreated medical waste. 5. The facility is permitted to use one sterilization (autoclave) unit. 6. The operating floor, trailer storage area and unloading docks are cleaned daily. 7. The floor of the operational pit was clean and free of debris. 8. Floor drains are connected to the City of Gastonia sanitary sewer system. Facility staff have installed screens on the drain grates to prevent waste from entering the floor drains. Floor drains are washed and cleaned weekly. 9. Facility staff pick up windblown litter periodically during the day around the compactor and at the end of each day. 10. During the inspection leachate was observed leaking from the rear of the compactor door seal area. The leak was pointed out to Mr. Weaver who stated he would contact Republic Services. Please see the Observed Violations section of this report. 11. All trucks are equipped with spill kits. 12. Treated medical waste is loaded into a compactor, then transported to CMS Landfill in Concord for disposal. 13. The facility has a refrigerated trailer on -site. 14. Every Tuesday hazardous waste is transported to Heritage in Charlotte, NC for incineration. 15. All pathological waste is transported to Covanta in Atlanta, GA for incineration. All medical waste received is processed by the next day. 17. All recycled containers are washed, disinfected, and inspected for damage prior to being returned to customers. 17. All treatment carts are relined after each autoclave cycle. Records Review 18. Once a week the autoclave is tested to ensure the sterilization is achieved. Spore test data records (Autoclave Quality Control Log) were reviewed from November 2022 to September 2023. 19. Reviewed RMW (Regulated Medical Waste) Container Logs from October 28, 2022, to September 14, 2023. Reviewed the Washline Daily Operators Log from November 1, 2022, to September 19, 2023. 23. The facility processed 2,525,653 lbs. of medical waste from November 2022 through August 2023.
