Permit to Operate renewal/Permit to Construct has been submitted and is under review. PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection without records review STATUS OF PAST NOTED VIOLATIONS: None applicable OBSERVED VIOLATIONS: There were no violations observed during this Facility Compliance Inspection. Please see the ADDITIONAL COMMENTS section below for details concerning this inspection. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 7407_INSP_20230919 Page 2 of 4 ADDITIONAL COMMENTS: 1) This facility is a Construction and Demolition Landfill, White Goods Collection, and Scrap Tire Collection facility. 2) This facility is permitted to receive Construction and Demolition (C&D) waste as defined in 15 NCAC 13B .0532(8); Inert Debris as defined in GS 130A-290 (a)(14); Land-clearing waste as defined in GS 130A-290 (a)(15); Asphalt in accordance with GS 130-294 (m); and regulated-asbestos containing material in accordance with 40 CFR 61 and 15 NCAC 13B .0542 (c). 3) This facility is permitted to receive the aforementioned wastes generated within a 100-mile radius of the Facility. Counties included in the permitted area are Beaufort, Bertie, Bladen, Brunswick, Camden, Carteret, Chatham, Chowan, Craven, Cumberland, Currituck, Dare, Duplin, Durham, Edgecombe, Franklin, Gates, Granville, Greene, Halifax, Harnett, Hertford, Hyde, Johnston, Jones, Lenoir, Martin, Nash, New Hanover, Northampton, Onslow, Pamlico, Pasquotank, Pender, Perquimans, Pitt, Sampson, Tyrrell, Vance, Wake, Warren, Washington, Wayne, and Wilson Counties. 4) Proper signage including the facility permit number, accepted waste types, banned or excluded items, hours of operation, and the emergency contact number is posted at the facility entrance. 5) The hours of operation are Monday through Friday 7:00 AM to 5:00 PM. 6) The facility is secured by means of a locked gate at the facility entrance. The gate was open and facility personnel were on site during this facility compliance inspection. 7) The entrance to the facility is well-maintained and no windblown debris was noted along the roadway approaching the site. 8) The facility access road is of all-weather construction and is being maintained in overall good condition. 9) Permanent Edge-of-Waste Markers are in place around the footprint of the landfill and are being maintained as required. 10) Facility groundwater monitoring wells were reviewed during this Facility Compliance Inspection. All reviewed wells were readily accessible, properly labeled, and secured with functional locks. 11) This Facility is currently operating in Phase 2B. 12) The active working area is being maintained in a compact and manageable size. 13) The waste type was reviewed; only Construction & Demolition waste was observed and no unpermitted waste streams were noted in the active disposal area during this Facility Compliance Inspection. 14) Facility personnel were covering and compacting portions of the active working face during this Facility Compliance Inspection. *Please continue working to ensure the active working area is being covered weekly or when it reaches ½ acre in size. Windblown debris was minimal and no windblown debris was observed outside of the permitted landfill disposal footprint. 16) Portions of the outside slopes of Phase 2 have recently been covered and graded. *Please ensure all newly covered and graded areas are seeded and mulched in order to establish a groundcover suitable to protect your landfill cap system in a timely manner. 17) Overall, a cover-crop of native warm season grasses has been established throughout the inactive areas of the landfill. However, areas of sparse cover were observed in the cover crop in various areas of the inactive portion of the landfill. *Within thirty days of receipt of this facility compliance inspection report, all bare areas should be covered and graded at a slope not greater than 3:1 and then seeded and mulched to establish a groundcover suitable to prevent erosion of your landfill cap system. 18) Certain areas of the cover crop do not appear to have been mowed in some time with some areas supporting small trees and other woody vegetation. *Within thirty days of receipt of this facility compliance inspection report, please mow the entire landfill cover crop and the area around the toe of the landfill. Moving forward, a regular maintenance mowing schedule should be instituted and followed to ensure the cover crop is mowed throughout the year and properly maintained as required. Exposed waste was observed in this damaged area. *Within thirty days of receipt of this facility compliance inspection report, please repair this area by properly covering the waste, then seeding and mulching the repair to establish a cover crop suitable to prevent erosion of the landfill cap system. 20) *Corrective measures are required as a result of this Facility Compliance Inspection.
