Not Resolved: 15A NCAC 13B .1626(2)(b) states: "Except as provided in Sub -Item (c) of this Item, the owners or operators of all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors. " Macon County is in violation of 15A NCAC 13B .1626(2)(b) for failing to cover all disposed waste with six inches of earthen material at the end of each day. On the morning of September 18, 2023, at 7:00 am, a pre - opening inspection was conducted to ensure that all waste was being covered as required by 15A NCAC 13B .1626(2)(b). An area of uncovered waste was observed on the eastern side of the tarp being used as alternative daily cover. The area of uncovered waste was approximately 21 feet by 36 feet. Uncovered waste was also observed in front of the tarp and on the western side of the tarp. To correct the violation, Macon County must immediately cover all exposed waste with at least six inches of earthen material at the end of each operating day. Follow up inspections will be conducted to ensure compliance with 15A NCAC 13B .1626(2)(b). Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photographs were taken by Lee Hill on September 18, 2023. 2. A pre -opening inspection was conducted to ensure that all waste was being covered as required by 15A NCAC 13B .1626(2)(b). An area of uncovered waste was observed on the eastern side of the tarp being used as alternative daily cover. The area of uncovered waste was approximately 21 feet by 36 feet. Uncovered waste was also observed in front of the tarp and on the western side of the tarp. Some exposed waste was observed on the interior slope of the cell. Ensure that all waste is covered with at least six inches of soil at the end of each day. 3. Following the field inspection, the lack of cover on and around the working face was discussed with Chris Stahl. Mr. Stahl stated that recycling staff were working on Saturday rather than the landfill personnel. 4. Two tires were observed in waste that was dumped in the first load of the day. Facility staff saw the tires and removed them from the working face. 5. Collection vehicles which had deposited their waste at the working face were observed driving approximately halfway across the top of the landfill cell before closing their rear doors. Waste was observed falling out of the trucks while they were moving across the cell. These trucks should shut their rear doors before moving away from the working face to prevent waste from becoming windblown or being tracked into the top of the cover soil. 6. The exterior slopes of the cell had good soil cover and no erosion issues were noted. The slopes had been seeded as of the July 25, 2023 inspection; however vegetative cover was minimal and the areas need to be reseeded to prevent the possibility of the slopes eroding.
