Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. David Powell with the Section visited Hoke County facilities for routine inspection. Mr. Powell met with April King Locklear, Hoke County Solid Waste Director, and Supervisor Helen Adams. Ms. Locklear and Ms. Adams assisted Section staff during inspection. Records for other facilities were well organized. Please create a file for all Closed MSW related sampling, permits, closure plans, repair to cap, wells, mowing etc. This can be reviewed during inspections. 2. The landfill was mowed and looked good as viewed from east and north sides. Shrubs and trees didn’t seem to be an issue during inspection but is difficult to tell the entire limits of disposal with some Edge of Waste (EOW) markers missing. Please reinstall missing EOW markers or where some are needed, one should be visible to the next, to mark the correct limits of disposal around the perimeter of the Closed MSW. Looking west. The well is surrounded by vegetation, had no lock and no identification on the housing. All monitoring wells at Hoke County site should be locked, have identification plates with correct identification name in accordance with 15A NCAC 2C. Please fix all wells lacking these items. Any proposed modification to an approved plan must be submitted to the Section Hydrogeologist for a review and approved prior to implementation. Please be sure any and all changes to wells, such as new installs or abandonment, onsite have been submitted to DEQ William Sugg at (919) 707 - 8258 or perry.sugg@deq.nc.gov. Upon records review, groundwater sampling data for 8/2023 was available. This data is completed by Pat Shillington Engineering group. After inspection, Mr. Powell spoke with SWS Hydrogeologist Christine Ritter about sampling data submittal. Ms. Ritter indicated Ben Kelly, benjamin.kelly@deq.nc.gov or 919-707-8327, was contact for Hoke Closed MSW. She also explained although the facility has been submitting the data as required, the county is still not submitting the lab data using the Solid Waste Section's new Equis EDD format. The county should begin doing so immediately AND contact Ben Kelly for guidance on how to meet this requirement. The county should also be sure their consultant/engineer firm is aware of this new contact and requirement as well. Frequent inspection of cap and edge of waste should be completed to inspect for missing EOW markers, shrub growth, erosion, settling and potential leachate seeps. Reminder: Any areas discovered should be repaired as the weather allows site staff to do so without further degrading. Any repairs to the site should be documented in your records and made available to Section staff for review. 6. Corrective measures are necessary as a result of this inspection. Corrective action should be completed within 60 days of receipt of this inspection report. Failure to meet the conditions for compliance may result in Compliance Actions. A follow-up may be conducted after the given time frame or shortly after.
