OBSERVED VIOLATIONS: None. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 ADDITIONAL COMMENTS 1. All photos were taken by Summer Justice during the inspection unless otherwise noted. 2. Site was secured with a 6-foot chain-link fence and gate to prevent unauthorized access. 3. Durable, weather resistant signs that stated the name of the operator, permit number, and operating hours were posted at the facility entrance. The facility possessed durable, weather resistant signs that stated the emergency contact, types of waste accepted/not accepted, and that hazardous or liquid waste cannot be accepted, which facility staff stated would be posted the same day of inspection. As discussed during the inspection, continue to maintain signage as necessary. 4. Traffic markers were posted around the site for traffic control. 5. Access roads at the facility were of all-weather construction and appeared to be maintained. Records Review 6. Tonnage records from the 2022-2023 Facility Annual Report showed that the facility received 161,565 tons of waste, for an average of 466 tons per operating day. 8. Waste screening reports were available for review for the period of July 1, 2022 to July 6, 2023. The forms showed the final disposition of any unacceptable waste that was encountered. As discussed during the inspection, continue to include pertinent information such as the date screening was performed on all waste screening reports. 9. The current Permit to Operate and approved operational plan were available for review. 10. Facility staff indicated that annual safety training occurs, but records are not kept. Documentation of 8-hour annual training including review of operations plan and permit shall be placed in the operating record. 11. Records of pre-regulatory landfill cap maintenance, facility maintenance, and monthly pressure washing of the tipping floor and push walls by facility staff were made available for review for the period of November 2, 2021-August 18, 2023. Operations Inspection of the Transfer Station 1108T-TRANSFER-1996 12. Residential customers dump waste in the old transfer station building on the western side of the property. Household recyclables including cans, plastic bottles, newspaper, etc., are accepted inside the northern receiving bay of the residential transfer station. Sharps, compostables, lead-acid batteries, and electronics are collected along the southern wall of the residential transfer station. The sharps are stored in hauler-approved containers and are picked up by Curtis Bay Medical Waste Services. Containers for collecting cardboard and scrap metal are located next to each transfer station building. 13. Accumulated waste was observed around the lead-acid battery storage area along the southern wall of the residential transfer station. Ensure that all waste is removed from the tipping floor at the end of each day. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Commercial customers dump waste on the tipping floor of the new transfer station building, which is enclosed by a pre-engineered, metal panel-type building. MSW is tipped on the eastern side of the commercial building and pushed into a hopper that fills a transfer trailer in the innermost (northern) loading bay. C&D waste is tipped on the western side of the commercial building and pushed into a hopper that fills a transfer trailer in the outer (southern) loading bay. 15. No unacceptable waste was observed on the tipping floor during this inspection. 16. The facility was equipped with fire extinguishers and water supply in the form of water hoses. The fire extinguishers were last serviced September 2022. 17. The tipping floor and push walls appeared to be in good condition, however, the tipping floor in the commercial transfer building showed some signs of spalling. 18. Some waste was observed on top of and behind the push walls. Ensure that waste is removed from these areas at the end of each working day, including the fine dust particulate that accumulates behind the push walls. 19. Waste was observed in both the residential and commercial transfer station loading bays, with some waste pushed out of the commercial MSW loading bay and into the trailer staging area. Ensure that waste is removed from truck loading bays at the end of each day to prevent windblown and vector issues. 20. The trench drains at the entrance of the tipping floor appeared to be working properly. Continue to clean and inspect drains for clogs at the end of the day as stated in the operational plan. 21. Drains in the loading bay and trailer staging area appeared to be working properly. In addition, no ponding was observed, and all leachate appeared to be contained within the collection system. The leachate collection system for the facility discharges to the Metropolitan Sewerage District of Buncombe County. 22. Windblown waste was observed in areas around the commercial transfer station building. Specific areas include around the scrap metal container, behind the tire trailer, and behind the propane tank container. Ensure that windblown is picked up and disposed of at the end of each working day according to 15A NCAC 13B .0405(10). Operations Inspection of the White Goods and Tire Collection Areas 23. One tire trailer was staged to the north of the commercial transfer station. No tires were observed outside of the trailer. 24. White goods are received in the above-mentioned scrap metal containers. The facility currently contracts with Biltmore Iron & Metal Co., Inc. for white goods and scrap metals removal/processing. Refrigerants are removed by Biltmore Iron & Metal Co., Inc. personnel. White Goods and scrap metals are removed from the facility for processing by Biltmore Iron & Metal Co., Inc. as necessary. During the inspection, white goods were observed being managed in a way that has the potential to allow escape of refrigerant gases. White goods containing refrigerants should either be stored separately from other scrap metal until refrigerants are removed to ensure the proper removal of gases, or, if white goods containing refrigerants are stored in the scrap metal container, the scrap metal container should not be compacted. Ensure that white goods are managed properly and that collection areas provide for effective removal of refrigerants.
