The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On August 22, 2023, Chuck Kirchner met with Shannon Culpepper to conduct a comprehensive inspection of the Chatham County Household Hazardous Waste Collection Facility on County Service Road in Pittsboro, Chatham
County.
1. The permanent household hazardous waste (HHW) collection facility is open nine months a year (March through November), every 3rd Saturday from 9:00 am to 3:00 pm. 2. The facility HHW generator identification number is NCPH0199501 and this number is used to ship waste offsite for recycling, treatment, or disposal. 3. The facility was not in operation during the inspection.
4. The facility is permitted to receive HHW from Chatham County.
5. The facility does not accept HHW from conditionally exempt small quantity generators (CESQG) or agricultural/large farm related materials.
6. The facility is prohibited from receiving any other types of wastes, including radioactive wastes, explosives, ammunition, infectious or medical wastes, and polychlorinated biphenyls (PCB) waste, with the exception of fluorescent light ballasts and PCB household waste. 7. If received, prohibited waste may be detained for appropriate disposal. 8. The collection of HHW is managed by ECOFLO, Inc., EPA identification number: NCD980842132. 9. ECOFLO, Inc. was recently bought out by Republic according to Ms. Culpepper.
10. ECOFLO, Inc. personnel receive training in accordance with 29 CFR, Part 1910.120(e) and 1926.65(e).
11. The following are HAZWOPER 29 CFR 1910.120(e) certified personnel, trained in facility operations:

• Chris Parsons, February 16, 2022. 13. ECOFLO, Inc. carries a spill kit in the truck they provide during collection events. A spill kit is also maintained in the main building along with a mercury spill kit which is located next to the first aid kit. In addition, there is a spill kit in the storage building. 14. Ms. Culpepper stated that a water line has been run to a valve hose spigot at the HHW building. 15. The eyewash station can now be kept in the HHW building and filled up and used during HHW events.
16. The eyewash station appeared in good condition and was empty during the inspection. 17. Incoming material is screened by ECOFLO, Inc. staff via verbal confirmation with the vehicle driver. A record of the driver’s name and address was reviewed from July 16, 2022 through July 15, 2023.
Materials are verified, unloaded, and sorted by ECOFLO, Inc. personnel. 18. ECOFLO, Inc. packages and hauls most HHW collected from each event and takes it back to the ECOFLO facility
in Greensboro, NC. Some material may be left until the next event if the truck is full. 19. Per the Operations Plan (FID 1390643) dated February 2020, “the date upon which each period of accumulation begins will be clearly marked and visible on each container. Furthermore, while being stored onsite, all containers with accumulating hazardous wastes will be labeled or marked clearly with the words, "Household Hazardous Waste" unless the material is recyclable (e.g., used oil, latex paints, batteries), or nonhazardous, and is separated from other hazardous waste.”

20. ECOFLO, Inc. has a pallet jack with a scale on it to give a rough estimate of what is being taken off site. A manifest is left on site with estimated quantities of what is being hauled off after each event. An accurate number is given via manifest once they get to the ECOFLO facility in Greensboro. 21. Manifests from ECOFLO, Inc. were observed from May 25, 2022 through July 31, 2023. 22. The facility building has a secondary containment sump and automatic fire suppression system. There are two concrete pads outside of the building each with secondary containment sump and automatic fire suppression system covered by an all-weather awning. 23. The automatic fire suppression system was last inspected by Pye Barker Fire & Safety Equipment Co.
in March of 2023. 24. There is a handheld fire extinguisher located inside of the building. Another handheld fire extinguisher is inside the storage shed.
25. The handheld fire extinguishers were last inspected by United Fire and Safety Equipment, Co. in August of 2023. 26. The secondary containment sumps do not have outlets. 27. Prior to a collection event and after any significant rainfall accumulation stormwater is pumped-out of the outdoor secondary containment sumps. The secondary containment sumps, if utilized, will be cleaned accordingly. 28. The three containment sumps are not connected, each function independently of the other. The facility building containment sump has an overflow reservoir, access is via concrete tile lid located behind the building. The tile lid is currently covered with a tarp due to water infiltration. 29. Facility supplies are stockpiled in a storage shed. 30. The facility conducts Weekly Facility Safety Inspection Log when facility is open and does inspection once a
month when facility is closed. Any problems or corrective action items are recorded on the back of the form. Records were observed from June 19, 2022 through August 19, 2023. 31. Other items are shipped out as needed but within one year: Batteries go to Cirba Solutions which was formerly
Battery Solutions in Wixom, motor oil and motor oil filters go to Clean Green/Resource Performers in Durham, NC and ECOFLO, Inc. takes all other types and sizes of tanks according to Ms. Culpepper. 32. ECOFLO, Inc. removes all waste from the site in November at the conclusion of the HHW season according to
Ms. Culpepper. 33. The facility has an emergency eyewash station. It is a portable unit mounted on the exterior wall of the facility building. Prior to each collection event it is refilled and tested. It is removed and stored when the facility is not in operation. The eyewash station was observed to be empty during this inspection. 34. Four 55-gallon drums were located just outside the HHW building used for the collection of used motor oil. The drums sit on a concrete pad that drain to one of the self-contained sumps. 35. A dumpster with water-tight lid is on site for municipal solid waste (MSW) received/generated from the HHW collection events. 36. A second recycling roll-off container is on site for cardboard received/generated from the HHW collection events. 37. The facility collects lead-acid batteries stored atop a pallet under an all-weather awning. 38. Fire extinguishers, refrigerant tanks and propane tanks collected are stored under an all-weather awning. 39. Blue Rhino will take the used propane tanks once there are 50 tanks to collect according to Ms. Culpepper.
40. The facility conducts pre-event and post-event inspections. Records were observed for June 19, 2021
through August 19, 2023. 41. ECOFLO, Inc. sends the facility a manifest of the materials picked-up. Manifests for material hauled-off by ECOFLO, Inc. were observed from May 25, 2022 through July 31, 2023. Quantities listed on
the manifests appear consistent with the annual report. 42. The facility annual report (FAR) was submitted to the SWS, dated July 31, 2023. The facility received 93,753 lbs. of HHW from July 2022 through June 2023.
43. The Pittsboro Fire Department can be contacted to respond to an emergency at the facility.

44. The facility is located on property containing the Division of Solid Waste and Recycling building, a closed municipal solid waste (MSW) landfill (19-01) and associated yard waste grinding operation and convenience site, and a notified land clearing and inert debris (LCID) landfill (N0069). The property
also includes three temporary disaster debris staging sites (TDSR): DS19-002, DS19-003, and DS19-004. 45. The site is secured by a chain link fence with lock. 46. The facility has proper signage.
