Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Proper signage was observed at the entrance of the facility. 2. The facility is permitted to receive solid waste within approximately 100 miles around the landfill. 3. The facility accepts an average of 95 tons per day. 4. Edge of waste markers were visible. 5. The working face was small and compact. 6. The facility is currently working in Phase 3B. 7. The facility had pulled two tires out of the working face and set aside to dispose of properly. No other unacceptable waste was observed. 8. A "roll off container" is staged near the working face for the collection of scrap tires. 9. All access roads maintained in good condition and the facility applies water to keep the dust down. 10. The facility is scheduled to mow the inactive areas in September/October. Records Review 10. Reviewed 2nd Semi-annual groundwater monitoring report sampled on November 2, 2022. Surface water monitoring is performed semi-annually with their groundwater monitoring. 11. Quarterly landfill gas monitoring is performed by Blue Flame LLC. 3' Quarter 2022, 4th Quarter 2022, 1" Quarter 2023, and 2°d Quarter 2023. 12. The facility utilizes soil for required cover which is applied weekly. Reviewed random inspection reports from August 29, 2022, to July 20, 2023. Facility staff perform one random inspection each day. Albert Glenn — SCS Engineers, PC Kim Sue — NCDEQ, DWM, SWS Topics Discussed 1. Reviewed the construction drawings and scope of work. 2. Mobilization of the contractor, Earnhardt Grading, will occur in two 2 weeks. Planned construction duration is 2 months. 3. Kevin Atkins will be contractor's superintendent. Phone number is 704-400-6589. 4. Lawrence and Associates, PA will be performing the record surveying. 5. Atlantic Coast Consulting, Inc. CQA technician has yet to be determined. 6. Pre -construction structural fill soil testing (from cell excavated soil and soil stockpile). Buckets of soil will be collected from both areas and sent to the laboratory. 7. Excavated soil from the cell construction area will be stockpiled in the future Cell 4B area. 8. The haul road, stormwater channel, and temporary geomembrane liner will be from extra liner located at the CMS Landfill. Channel length is 780 feet. 9. Construction progress meetings will be every two weeks on Thursday at 10:30 a.m. First meeting is tentatively August 24. This is dependent on when contractor starts construction.
