STATUS OF PAST NOTED VIOLATIONS:
A. Not Resolved: 15A NCAC 13B .1626(2)(b) states: "Except as provided in Sub -Item (c) of this Item, the owners
or operators of all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end
of each operating day, or at more frequent intervals if necessary to prevent the escape of waste and the
attraction of vectors and scavenging, and to minimize fires and the generation of odors. "
Macon County is in violation of 15A NCAC 13B .1626(2)(b) for failing to cover all disposed waste with six
inches of earthen material at the end of each day. On the morning of July 25, 2023, at 7:08 am, a pre -opening
inspection was conducted to ensure that all waste was being covered as required by 15A NCAC 13B
.1626(2)(b). Uncovered waste was observed to the north of the tarp which was being used as alternative daily
cover. Uncovered waste was also observed along the interior slope, south of the area where the tarp was located
as well as in front of the tarp.

To correct the violation, Macon County must immediately cover all exposed waste with at least six inches
of earthen material at the end of each operating day. Follow up inspections will be conducted to ensure
compliance with 15A NCAC 13B .1626(2)(b).

Exposed Waste on Interior Slope
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on July 25, 2023.
2. The facility is open to the public Monday through Friday, 7:30 am to 4:30 pm, and Saturday, 8:00 am to 2:00 pm.
3. The landfill is secured by gates, fencing, the Little Tennessee River, and other natural terrain to prevent
unauthorized entry.
4. Signage was installed at the entrance to the facility providing the hours of operation, permit number, emergency
contact information, types of waste that are accepted and that hazardous or liquid wastes are not accepted.
5. The access roads throughout the facility were of all-weather construction and were being maintained.

8. Landfill Operations Specialists:

9. Waste screenings from August 19, 2022 to July 21, 2023 were available for review. The forms showed the final
disposal of any unacceptable material that was encountered.
10. Landfill gas monitoring was conducted on September 21, 2022, December 8, 2022, March 28, 2023, June 27,
2023, and June 28, 2023. No landfill gas exceedances were noted at the property boundary.
11. Tonnage records were reviewed from the 2022-2023 Facility Annual Report. The facility disposed of 39,708
tons waste from July 1, 2022 to June 30, 2023.
Operational Inspection of the MSWLF (5703-MSWLF-1992)
12. The facility is currently filling on the northeast side of Phase 3, Cell 1.
13. A pre -opening inspection was conducted to ensure that all waste was being covered as required by 15A NCAC
13B .1626(2)(b). Uncovered waste was observed to the north of the tarp which was being used as alternative
daily cover. Uncovered waste was also observed along the interior slope, south of the area where the tarp was
located as well as in front of the tarp. All waste must be covered with six inches of earthen material at the
end of each operating day. See Status of Past Noted Violations for additional information.
14. After daily operations commenced, the working face was small, compact and no unapproved waste was
observed.
15. The exterior side slopes of Phase 3, Cell 1 had good soil cover and had been seeded.
16. Multiple leachate seeps were observed on the northwestern slope of Phase 2; however, no leachate was
observed off the liner. Facility staff stated that they would begin repairing the seeps immediately. Daily
inspections of the area should be conducted to ensure that any future seeps are identified and repaired to
prevent the possibility of leachate leaving the lined disposal cell.
17. Groundcover sufficient to restrain erosion was established on the side slopes of Phase 1 & 2.
Operations Inspection of Yard Waste Treatment and Processing Facility
18. The yard waste treatment and processing area is located to the northwest of the active landfill cell and accepts
untreated, unpainted pallets, wood, leaves, and land clearing debris. The collected material is ground and is
used as approved alternative daily cover for the landfill. No ground material is distributed to the public.
19. The facility has a dumpster staged in the area to collect any unacceptable waste that is found in incoming loads.
20. A small amount of metal was observed on some crates that were recently dumped. Remove the unapproved
material from the stockpile.
21. The yard waste area has an access road around the unground stockpile that can be used by emergency vehicles
in the event of a fire.
Other Comments
22. Recyclables were observed on the ground that appeared to have fallen out of loaded dumpsters in the recycling
area. Efforts should be made to ensure plastics, paper and other wastes are not allowed to remain on the ground
in the recycling area, where they can come into contact with storm water.
23. White goods containing refrigerants were being stored upright and separately from other scrap metal to prevent
the unintentional release of refrigerants into the environment.
