Current Permit to Construct and Permit To Operate 2615-LCID-2022, (Previous CLOSED Permit 26F-LCID-1986) Issued September 1, 2022, and expires September 1, 2027; Currently Phase 1 (4 Acres) will be permitted to operate. PURPOSE OF SITE VISIT: Comprehensive Inspection – Follow Up / Pre-Operation The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Permit Attachment 3, Part V, 16 - RESOLVED OBSERVED VIOLATIONS: NA ADDITIONAL COMMENTS 1. From 1986 to 1992, a demolition landfill operated on this property, permitted as 26F. Most of the waste from that is in the approximate area of the western end of the LCID. The demolition landfill was later called an 26F-LCID (land clearing and inert debris) landfill and was certified closed in May 2011. In 2022, a new LCID landfill, permit 2615-LCID-2022 in conjunction with 2610-COMPOST-2011, has been permitted at the site of the Wilkes Rd Facility. Facility is not operating atop LCID currently. 2. Section staff David Powell met with Cumberland County Solid Waste (CCSW) staff, Amanda Bader, Mike Renfrow, Neil Cunningham, and Tim Middleton. As noted in the report for 2610-COMPOST, signage needs updating to meet current requirements and incorporation of both site permits. Traffic signage was also present, please evaluate those already installed during this time to ensure additional is not needed. 3. Mr. Powell rode across LCID with CCSW and some of perimeter. Site has been mowed but will need again soon. Previously mentioned ruts and seep area seem to have been appropriately addressed. Please keep check in future for additional breakouts in these areas. Edge of Waste (EOW) markers were installed and easily visible. Good job. Soil is being staged nearby. Please be sure and keep enough cover for operating working face but also for firefighting, as described in permit. Northwest corner with EOW marker visible and perimeter road. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 6 4. Spread out across the LCID top was mulched yard waste (YW) several feet thick. CCSW staff stated this waste mulched YW from during the temporary approved operations on top of the LCID after fire at compost side. This mulch was spread out and left. Waste needs to be utilized according to Compost or LCID rules. Looking south on top LCID. Previous inspection was to verify if site had met pre-operation conditions and all structures were installed onsite as designed. The final stormwater basin is installed onsite and operating. CCSW staff stated they were still addressing issues onsite with stormwater and Sedimentation and Erosion Control Plan. Vegetations is needing to be established along the north and south roads leading east. Please pull back composted product too close to water in ditching. Roadway should be of all weather construction once repairs are complete as well so that fire fighting equipment and Section staff vehicles can have access. New Stormwater basin on LCID side. View is south. 6. A Notice of Deficiency Resolution Letter will be sent, while copying Solid Waste Section Permitting. An updated Operations plan has been submitted to Section Permitting and awaiting approval. Please be sure to complete and submit the Facility Annual Report for this site. 8. Corrective actions are necessary as result of this inspection. Corrective actions should be completed within 30 days from the date of this inspection report sent. A follow up may be conducted once these issues are addressed in the given time frame or shortly after.
