Sean Mclean, RWK, PA Engineering STATUS OF PERMIT: Notified LCID – CLOSED – Start Post Closure Care PURPOSE OF SITE VISIT: Comprehensive Inspection - CLOSURE STATUS OF PAST NOTED VIOLATIONS: 1. 15A NCAC 13B .0567 (b) (2) - RESOLVED. OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Waste not being accepted at this NLCID. Closure activities should be completed onsite, beginning with Post Closure Care. REMINDER: this site is a 2-acre NLCID, with a previously allowed 50-foot extension on the West end of landfill. Northern side slope, EOW marker in back photo in center. The site has had additional soil cover put on several areas of side slopes. Grass should be established for Winter and then perennial grasses established in spring for permanent cover. This structure should be maintained with Post Closure Care according to Rule 15A NCAC 13B .0567 for ten years. 3. Erosion rills have been addressed, soil has been added and sloped accordingly. The area has been hydro seeded once and will be again a few days after inspection. Some grass seeds are already germinating. 4. Edge of Waste Markers (EOW) were visible on the corners of the NLCID. 5. Slopes looked good, with soil compacted and erosion repaired. NLCID roads should be of all-weather construction and maintained for access for future inspections, should they be needed. Please maintain and fix road access. Road access is still present around perimeter but may need some periodic maintenance to stay “all weather”. 6. Temporary water control structure on top of NLCID on North side to allow for diversion of stormwater while newly hydro seeded grass establishes. Once established, Mr. Byrd stated the soil berm would be removed and staged nearby for any future erosion repair needs. Other soil is present for this need as well. The onsite discussion consisted of maintaining current fixes, hydro seeding in next couple weeks a second time to ensure good grass establishment, Post Closure Care rules and future expansion of nearby Permitted LCID, also owned by 401 Sand. 8. This Notified Land Clearing and Inert Debris Landfill is considered CLOSED, and no longer able to accept waste. To do so may be in violation of NC Solid Waste Rules. Please communicate with Solid Waste Section Permitting for any final closure needs. A copy of the 15A NCAC 13B .0567 rules will be sent with this inspection report link.
