Pending Approval. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: No past violations noted The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Mecklenburg County Land Use and Environmental Services Agency Solid Waste Division Page 2 of 3 OBSERVED VIOLATIONS: A. 15A NCAC 13B.1406(19)(a) states: " Facilities permitted as Large Type 1, Large Type 2, all Type 3, and all Type 4 shall have an operator, supervisor, or manager trained in accordance with the requirements in G.S. 130A- 309.25. No less than one trained operator, supervisor, or manager meeting the requirements of this Sub -item shall be onsite during the facility's operating hours or available at a phone number provided in the facility permit. (i) Training in accordance with G. S. 130A- 309. 25(c) shall be required every five years. (ii) Persons who have achieved and maintain compost operator certification by the US Composting Council Certification Commission or equivalent shall be considered as having met the training requirements in G.S. 130A- 309.25for the permitted facility." Wallace Farm Inc. is in violation of 15A NCAC 13B 1406(19)(a) in that the Huntersville County Compost Facility does not have a trained operator, supervisor, or manager on site during the facility operating hours or available at a phone number provided in the facility permit that meets the requirements of 15A NCAC 13B 1406(19)(a) ADDITIONAL COMMENTS: 1. Facility is secured with a fence and lockable entrance gate. Proper signage was observed at facility’s entrance. 2. Scale house attendants were present, screening and weighing incoming loads. 3. Interior roadways are of all-weather construction and are well maintained. 4. Standing water was observed during inspection. Mr. Wallace stated they will start regrading once the water has dried up. 5. A 100 feet buffer appears to be maintained between composting activities and property lines. 6. Windrows are below the permitted dimensions of 7 feet in height and 16 feet in width. 7. Stable compost appears to be within 60 feet high and 200 feet wide. 8. Unprocessed yard waste stockpiles are below the permitted dimensions of 30 feet in height and 50 feet in width. 9. Adequate space for firefighting equipment is maintained between stockpiles. 10. Small amount of fugitive dust was observed during inspection. Mr. Ramirez stated that the roads are sprayed throughout the day. 11. Vectors were observed in the grease trap waste and on the newly turned windrows. 12. Stormwater appears to flow away from operational areas and towards stormwater pond. 13. Reported complaints came from several homeowners in the surrounding neighborhood about odors coming from Wallace Farms. An Odor Response Form is filled out whenever there is an odor complaint. 14. Facility Annual Report for FY 21/22 was submitted to NCDEQ – Solid Waste Section on July 28, 2022.
